Brian Shinkle, Edwards County States Attorney knows all the dirty legal tricks.

Beginning in the 1970s, restraining orders became a tool to help protect battered women. This is as it should be. However, in the rush to protect the abused, the rights of the accused are being violated on an arguably unprecedented scale. Many if not most domestic violence restraining orders are simply tactical maneuvers designed to gain advantage in high stakes family law proceedings. The Illinois Bar Journal calls the orders "part of the gamesmanship of divorce.”
A recent article in the Family Law News, the official publication of the State Bar of California Family Law Section, explains that the Bar is concerned that "protective orders are increasingly being used in family law cases to help one side jockey for an advantage in child custody,or divorce.” The authors note that protective orders are “almost routinely issued by the court in family law proceedings even when there is relatively meager evidence and usually without notice to the restrained person....it is troubling that they appear to be sought more and more frequently for retaliation and litigation purposes.” According to the Justice Department, two million restraining orders are issued each year in the United States. The vast majority of these are related to domestic violence allegations. For example, according to California Attorney General Bill Lockyer, 243,401 of the 274,482 restraining orders currently active in California are related to domestic violence. Such orders are generally done ex parte, without the accused's knowledge and with no opportunity afforded for him to defend himself. When an order is issued, the person is booted out of their own home and can even be jailed if the person tries to contact the children. This helps person position themselves as their children’s sole caretakers, which aids them in winning sole (or de facto sole) custody of their children in their divorce settlements. In California and other states, the order itself can be considered a finding of domestic abuse, making the restrained person ineligible for joint custody. Despite these grave effects, many courts grant restraining orders to practically any person who applies. District Judge Daniel Sanchez, who issued the restraining order, explained "If [applicants] make a proper pleading, then I grant it.” Research shows that these orders often do not even involve an allegation of violence. Usually all that’s needed is a claim that the person to be restrained “acted in a way that scared me” or was “verbally abusive”—what’s known as “shout at your spouse, lose your house Their use should not be permitted to turn our judicial system into a series of Kangaroo Courts.

It's Obvious that Brian Shinkle, Edwards County State's Attorney in Albion, Illinois used the Illinois Bar Journal's guidelines when he launched a secret sneak attack against his wife and children when he filed the "Emergency Order of Protection". It was an attempt by Mr. Shinkle to further humiliate his family. This falls under the category of COWARD. What kind of man does this? It probably would have been more civil to ask for divorce rather than bash his family in the back of the head with a snow shovel several times.
Mr. Shinkle wears his "christianity" on his left and right sleeve for all to see. Is this how "christians" act?

Do the people that employ Tracy Beuligmann and the Edwards County States attorney have a right to know how the Edwards County computers are being used? After all the computers were paid for by the taxpayers. and oh isn't the salary paid for by the .......taxpayers?

Okay grayville girl (from Fairfield)...if they are wireless, wouldn't it stand to reason that they'd be on ALL THE TIME? Which they're NOT? The computers they sign in on might be wireless...but why did they set them up/sign in AT WORK? or are they AT HOME when they should be working? Is this just getting worse and worse? I think so.

The problem people are having here is that they're on DURING WORK HOURS, which are limited. Now, WHY ARE THEY ON DURING WORK HOURS? Don't they WORK? Don't they get BIG PAYCHECKS AT THE TAXPAYERS EXPENSE? Yes.

Things keep getting worse for Eliot Spitzer. The New York Times says federal prosecutors are scrutinizing the outgoing governor's encounters with prostitutes for any evidence that he used campaign contributions to pay for lodging or transportation.

Is it okay to use campaign funds for personal stuff.......like paying real estate taxes on a house, or paying for running shoes, or paying for a new bike or paying for lots and lots of liquor?

Don't copy and paste nything from the Edwards County SA's my space web site..........although it has been sanitized quite a bit!!(No more chocolate dipped gun barrels from Miss First!) Also cleaned up are the my space sites of the Edwards County SA secretary and someone named Jodi. Thank goodness for print screen when they were active!
I don't think that My Space is intended as a "work website" but they do seem to surf during their work hours; on county owned computers.

What number DUI..........more than 2 so this would be 3rd DUI, so definitely serious sitch. What was the outcome..........well the states attorneys' divorce attorney got a deal for his client. Is this fair?

The Edwards County States Atty Brian Shinkle apparently had some sort of break in reality, or break down......after the judicial race that he lost. He threw his entire family out of their house and filed some sort of order of protection papers in secret. Bizzare. I don't know where they live but he stayed in the house......too weird.

If parents knew they would spend $50,000+ each in a custody battle they might just cooperate on a parenting plan, and they MIGHT reconsider divorce.

When the legal case is over, the attorneys, the judges, the guardians and the mediators go away. All that's left are a father, a mother, and their children, who must live with what has been done to them.
