Not my kid. She is smart enough to leave her phone alone while driving. This was not a mistake but a blantant disregard for safety and human life.

What he did was STUPID! You should not make excuses for someone who took a life because he CHOSE to disregard everyone else's safety including his own! If he would have killed you and or your family, I doubt you would be fighting so hard for his "mistake"! You can't make me shut up and not voice my opinion when it is very relevant. If you aren't smart enough to teach your kids what is and isn't acceptable while driving then both you and they should Not Drive!

I know this young man, and his family. They are good people, and Emery and his brother are very respectful, talented and kind boys that would give you the shirt off of their back. This is a tragic accident, and could have been avoided very easily. But before you all go bashing Emery, please keep in mind that he is not the only one to text while driving. Most of us are guilty of texting, or using our cell phone while driving at some point. Those of you that don't think your kids do it, most of them do. This could have happened to most of us at one point in time. All it takes is taking your eyes off of the road for a second or two. The next time you drive down White Sands, or are sitting at a light, take a look around you, and you may be surprised by how many ppl of ALL ages are on their phones in the drivers seat. Please find it in yourselves to pray for both the men involved in this sad accident, and learn from it rather than bashing someone who is a good person that made a common mistake. He has to live with this mistake for the rest of his life, while most of us will continue to text and drive and risk making the same mistake on a daily basis.

I'm sorry but I think that you need to wake up and realize that everyone makes mistakes, and some are luckier than others. In fact, there have been many times that I have been driving the speed limit in this "Retirement" town, when an elderly person pulled out in front of me and I have had to slam on my brakes. They could have killed me, because they weren't paying attention…and they weren't even on their phone! But i'm sure you have never used your phone while you were driving or taken your eyes off of the road for a few seconds.. right? Emery did not murder this man, he killed him and it was an accident. It was not intentional.

I'm not bashing him, I'm saying what he did was very stupid, and the people that think what he did is not and everybody does it so give him a break is also stupid. I will bet money that now Alamogordo will make driving while on the phone illegal just like everywhere else. So then the next person that kills someone like this I hope can face the same charges as a drunk who killed someone. The stupid choices you make need consequences, Especially when it has cost someone their life. You don't agree.... Oh well maybe you will be the next one we are talking about.

Whats needs to be done is make this guy a poster child of what happens when you mess up. Throw the book at him to make all the other teens and young adults get the point of what happens when stupid mistakes are done. This will get the attention of our younger generation on texting and driving.

I never said that I didn't think that it was stupid, it in fact is very stupid to text while driving. Unfortunately, tons of people do it on a daily basis, along with making phone calls and other things. What i'm saying is that I feel that it is unfair for him to be treated like he is the only one doing wrong, when this could have happened to any of those people. I agree that Alamogordo should make it illegal to use your phone while driving, for citizens and POLICE officers.
There are murderers, drug dealers, rapists and child abusers out there that hurt people intentionally. I'm sorry, but a young man who made a mistake of sending a text while driving and killed someone definitely deserves to be punished, but does not deserve to be treated or viewed like one of those people. If it were the other way around and the older gentleman had pulled out in front of Emery because he hadn't looked or wasn't paying attention (like so often happens in this town) and Emery died, what would your opinion be then?

Throw the book at him just because he was the first one in this town to get caught causing a major accident? How many accidents do you think have happened in this town due to texting and driving? They should have made this illegal a long time ago in this town, just like almost every other city in New Mexico did. No, instead lets make an example out of an amazing athlete with a clean record so that everyone will remember that it's a bad idea to text and drive. Oh, and FYI I work for a local cell company and I assure you that it makes you sound very ignorant to state that the younger generation is the problem..People of all ages are making this mistake, and admit it on a daily basis.
