Summit deputy cleared of perjury, falsification by Grand Jury

Sheriff Drew Alexander's legal counsel presented testimony against Griffin during a hearing in Akron Municipal Court in August, and the judge found probable cause to charge him with the offenses.
Alexander later placed Griffin on indefinite leave without pay.
Griffin then was one of 30 deputies who were laid off in December over budget shortfalls.
Donald J. Malarcik, Griffin's lawyer, said he is deciding whether to seek reinstatement as a deputy.
''He loves being a sheriff's deputy,'' Malarcik said,''but he hates the politics of the sheriff's office.''
Griffin filed a union grievance against the sheriff last year, seeking reinstatement, but it was placed on hold during the criminal case, Malarcik said.
He said the grand jury action showed that Griffin told the truth all along,''and the truth has now set him free.''
Alexander said he was disappointed by the no-bill. The sheriff's office has an ongoing internal investigation into com
ments made by Griffin to various investigators in the McCullaugh case, he added.
''We still have three different statements he made under sworn oath,'' Alexander said.''In our opinion, the three of them are different.''
He said he would fight any effort by Griffin to return to work.
''I feel he lied on an investigation and I don't think he can be a law-enforcement officer if he can't tell the truth,'' Alexander said.
McCullaugh, who was 28, died Aug. 20, 2006, after a violent struggle with sheriff's deputies in his cell in the jail's mental health unit.
The Summit County Medical Examiner's Office later determined that the cause of death was asphyxiation from blunt-force blows and the combined effects of chemical, electrical and physical restraints on his airway.
Five deputies subsequently were indicted in McCullaugh's death.
Key witness
Griffin was a key government witness in grand jury testimony and the murder trial of Deputy Stephen Krendick in the summer of 2008.
He testified that he saw Krendick standing on top of McCullaugh's jail cell bunk and stomping on the inmate's head during the struggle.
However, Krendick was acquitted in a ruling by a visiting judge, Herman F. Inderlied of Geauga County, who was appointed to the case by the Ohio Supreme Court.
In a journal entry issued only hours after the eight-day trial, Inderlied said the government failed to prove that McCullaugh died of asphyxiation. The ruling was not released publicly until several days later.
''It is more likely,'' Inderlied wrote,''that Mark D. McCullaugh died from sudden cardiac death following his struggle with Summit County deputies and due to the adverse impact of that struggle on his pre-existing severe arteriosclerotic cardiovascular disease prior to the use of drugs or the use of [pepper] spray by the defendant.''
Charges against the other four deputies were dropped after Inderlied's ruling.
Griffin also gave statements to investigators during the proceedings of a wrongful death civil lawsuit filed by the McCullaugh family.
In November, an insurance company representing Summit County paid $862,500 to the family to settle the suit.
McCullaugh's death, according to FBI statements before the settlement was reached, still is being investigated by attorneys from the U.S. Justice Department for possible civil-rights violations.
A Summit County grand jury has decided there was insufficient evidence to file perjury charges against a sheriff's deputy who testified against fellow deputies in the 2006 death of jail inmate Mark D. McCullaugh Jr.
The action, called a no-bill, was taken Monday in the case against Joshua R. Griffin, 26, of Rootstown.
It means that five counts of perjury and one misdemeanor count of falsification — filed against Griffin last year by his own agency — have been dismissed.
