False Charges Dismissed Against Heath Wetherington

False unfounded charges against 29 year old Heath Russell Wetherington of North Augusta for first-degree criminal sexual conduct with 3-year-old girl have been dismissed. Magistrate Court Judge Danny Lynn ruled at a probable-cause hearing Wednesday afternoon that there was not probable cause to proceed to trial.

"In my opinion, the state did not meet probable cause for the charge, and that's why I did not bind it over," Lynn said.

Wednesday's probable-cause hearing was a routine preliminary hearing to determine whether or not probable cause exists. Lynn said that the solicitor's office could still proceed and directly indict Wetherington through a grand jury, if they believe that they have enough evidence.

Solicitor J. Strom Thurmond said that the solicitor's office considers pursuing a direct indictment on a case-by-case basis, which he said happens "on occasion."

Wetherington was arrested on Sept. 2 and was later released on $100,000 bond.

Because Wetherington is the nephew of former North Augusta Public Safety Director Lee Wetherington, North Augusta Public Safety referred the case to the South Carolina Law Enforcement Division.

This is another case of false arrest in Aiken County. Given that probable cause did not exist for his arrest, he should sue the officer, along with the agency, who swore out the warrant against him lacking probable cause within the two year statute of limitations for defamation per se, false arrest, false imprisonment, civil conspiracy under the SC Tort Claims Act and U.S.C. Section 1983. The same bogus garbage occurred against Stephanie Kirkland who is now suing them for such nonsense. Further, Judge Donna Williamson had the authority to set bond, she is only prohibited in cases of murder and treason and she knows this fact. Bond in cases like this are typically set at the first bond hearing at the Aiken County Detention Center.

He should look at the summons and complaints filed in other cases where sheriff mike hunt, ACSO, North Augusta and the City of Aiken have been sued for similar cases of false arrest, abuse of process, prosecutorial misconduct and defamation. He will need to get a lawyer who's not from Aiken. Lawyers who handle cases like this are Cromer Mabry, Dennis Bolt, Jake Moore, and Mark Hardee to name a few in South Carolina. This was a knee jerk reaction where they knew the wasn't enough evidence to make an arrest - the officer who signed the arrest warrant started this occurrence. When the arrest warrant was served is when the clock starts on the two year statute of limitations.

The sled agent involved in this case is a slap against all law enforcement. She should never be allowed to handle another case involving a child.

Who was the SLED agent. SLED along with any other agency involved in this case should be sued in federal court for section 1983 civil rights violations just like Stephanie Kirkland and Jeff Nation sued them for such foolishness when probable cause for arrest did not exist. A notorized copy of all magistrate's hearing should be obtained as evidence along with arrest warrants, investigations, etc. Cromer & Maybry (Columbia), Mark Hardee (Columbia), Dennis Bolt (Columbia), John O'Leary (Columbia), John Henry (Greenville) and Butcher (Camden) handle these kind of civil rights cases which should be filed within two years of the initial false arrest.

We are surprised to learn that it wasn't local SLED agent Mike Perry. He is their puppet and will arrest or not arrest anyone they tell him to in Aiken County = the sheriff and solicitor have a ring in his nose.

It could have been that crazy nut Aiken County Sheriff's Deputy Tommy Platt who operates the polygraph. He's been known to emblish the truth to get arrest warrants signed or when testifying in trials.

The charges were dropped because there was no evidence! The SLED was unsupervised and ran wild. There was a relationship with the agent and the step mother her made many false claims. Bottom line this was custody battle and the father did not want to pay support and him and his wife made false claims that found to be untrue and in the case that was brought forward the judge was amazed by there many bogus activities!

He should sue for false arrest, misconduct, etc. within two years. There are many summons and complaints at the Aiken County Courthouse where people have sued Sheriff Mike Hunt (Jeff Nation, Russ Ferrara, Stephanie Kirkland, etc.). SLED will do anything Mike Hunt tells them to do. IF you don't believe this just ask Jeff Nation.

Did they get Magistrate Tracey Carroll to sign the arrest warrant? She's in their pocket and married to Lt Bill Fleury who works for Sheriff Mike Hunt over criminal investigations. This is a direct conflict of interest and she knows that this is judicial misconduct when she gets involved in these cases with the Aiken County Sheriff's Office.

The ex sled agent that was just arrested for manslaughter for shooting and killing her boyfriend in North Augusta is who arrested this innocent man. Her name is Robin Herndon, formerly known as Robin Newton.
