LAFAYETTE — A 2011 DWI case involving a former Lafayette Parish sheriff’s deputy is likely among the case files the FBI confiscated during a Feb. 27 search of the 15th Judicial District Attorney’s Office, District Attorney Michael Harson said Monday.

Lawrence’s blood-alcohol content registered 0.153, nearly twice the legal limit, according to his citation.

Lawrence entered a plea of no contest to a misdemeanor first-offense DWI under Article 894, a state law that allows a conviction to be set aside and the prosecution dismissed after the defendant’s probation ends.

Court records indicate Lawrence’s probation was terminated before it ever began because his plea was taken under what Harson calls an “immediate 894.”

Harson explained last week that an “immediate 894” essentially speeds up the judicial process by allowing defendants, in this case DWI offenders, to pay their court costs and fines and to perform all necessary substance abuse and driver improvement classes prior to appearing in court.

If the defendant does so, then the judge and prosecutor can agree to waive the probation period and set aside the conviction, Harson said. This allows the case to be treated as an acquittal when it is sent to the Department of Motor Vehicles, meaning it will not appear on the offender’s driving record, Harson added.

As part of Lawrence’s plea, Williams stipulated in court records that Lawrence’s blood-alcohol content was below 0.15, a move that kept Lawrence from serving at least 48 hours of jail time as required by state law.

Williams also agreed to dismiss the careless operation and hit-and-run citations against Lawrence, court records show.

Additionally, Williams allowed Lawrence to submit a document from the Acadiana Outreach Center that states Lawrence completed 32 hours of community service. The document shows that seven hours of the community service were performed six days before he was arrested.

Asked for a clarification on Monday, Harson issued the following statement:“The implication is that it may have been taken during the (FBI) search executed at our office on Monday, Feb. 27, but I can neither confirm nor deny that.”

Williams says it is not uncommon for the state to stipulate that a defendant’s blood-alcohol content was below 0.15 even though it may not have been.

Williams said he did not know offhand how many “immediate 894” pleas his office has handled, but he said such pleas are available to those who want it.

“You can do it as soon as you can, if you want to,” Williams said.

Rubin said he was first approached by the District Attorney’s Office about handling “immediate 894’s” about two years ago. He said he’s unsure how many he’s handled since then, but he estimated that it had to have been more than 20.

“The one thing I found bizarre was that I didn’t see any blacks or minorities in the ones they asked me to hear,” said Rubin, who is black.

In an earlier interview, Harson said he realizes the majority of people might not realize the “immediate 894” is available to them.

“I will do it in some cases but I don’t advertise it,” Harson said.

Harson, meanwhile, confirmed that his longtime secretary and office manager, Barna Haynes — whose duties included pulling files for defendants who request the pretrial diversion program or who want to plead under Article 894 — was placed on unpaid administrative leave earlier this month.

Haynes being placed on unpaid leave “was not taken as a reflection of any criminal activity,” Harson said.

The district attorney has yet to name the employee targeted by the FBI in its probe.

It's pretty quiet out there regarding this snafu.

How many VPSO Deputies took advantage of Harson's Immediate 894 to keep their driving record clean?

Of course, when the VPSO gives you a free ride home and no accident report is filed....it never happened, right?

Maybe you should get your eyes checked, slayer, and re-read that article in the paper.

Strangely absent from the news, is Iberia parish D.A. Phil Haney. I hear he was in court a few weeks ago concerning some improper handling of things. I guess he has a few friends in the media, as this didn't make the news.

You can't compare Haney's situation to that of the fifteenth judicial DA's office. Haney is being investigated for a conflict of interest from 2007 when he negotiated a personal injury settlement while in elected office.

Harsons office has been raided by the FBI on the contigency that the his District Attorneys office was providing protection to guilty cops.

Big difference.

Ok, I guess Ill spill the beans, Bart left the position to follow his dream.:e recently won on a scratch ticket 250,000.... He's opening up a deer hunting lodge out of state. They just started breaking ground on the lodge,its going to b gorgous!:):)

I like hunt rabbits, deer,squirrels, coons and ducks. I never shot a bear. Seen quite a few, though. I don't think my pulley and gambrel will hold a bear. Dats a lot a skinnin'. It would make a nice rug for the lodge though.
