See Public Inspection and Disclosure of Form 990-T for more information.

An exempt organization is not required to disclose Schedule K-1 of Form 1065 or Schedule A of Form 990-BL. With the exception of private foundations, an exempt organization is not required to disclose the name and address of any contributor to the organization.

A political organization exempt from taxation under section 527(a) must make available for inspection and copying its report of contributions and expenditures on Form 8872, Political Organization Report of Contributions and Expenditures. However, such organization is not required to make available its return on Form 1120-POL, U.S. Income Tax Return for Certain Political Organizations."

Eric Holder was guilty of contempt over Fast and Furious and when reminded of this by a Republican before the Congressional panel after stonewalling (again) about the IRS scandal, he went crying to Al Sharpton's crowd that everyone was being mean to him and he and Obama were being treated differently.

The color of his skin just comes in handy to aid in covering up his and Obama's political deceptions. That's all that's going on here with skin color.

And it's getting really annoying.

After Congress found the nation’s top law enforcement officer in contempt Thursday, the Department of Justice quickly wrote a letter to House Speaker John Boehner informing him that it will not prosecute U.S. Attorney General Eric Holder for withholding documents in a congressional investigation of the Fast and Furious gun walking operation.

The House voted to pass a resolution which for the first time in U.S. history found a sitting U.S. attorney general in criminal contempt of Congress.

Once again self reporting by the exempt agency is not the same as the IRS releasing records.

Common sense would tell you that a congressman would not need to request info about a group that has posted their information and it is already available. Nor does he have the right to snoop around in records of those who have not obtained an exemption as an individual member of congress.

The current policy

"GN 03313.105 Disclosure to Congressional Committees or Subcommittees and to Individual Congressional Representatives

A. Policy

1. Requests from a committee or subcommittee

a. Non-tax return information

The Privacy Act (5 U.S.C.§ 552a(b)(9)) permits SSA to disclose non-tax return information to Congress for matters within the jurisdiction of a particular committee or subcommittee of either house or any joint committee or subcommittee of the Congress. Disclosure may be made when requests are received from:

•the Speaker of the House on behalf of the House of Representatives,

•the President of the Senate on behalf of the Senate, or

•the chair of a committee or subcommittee on behalf of one of those bodies.

NOTE: Disclosure may not be made to individual members of Congress on this basis (these disclosures are covered in GN 03313.105A.2.).

b. Tax return information

SSA may disclose tax return information without consent to Congressional committees only under certain circumstances, and with the approval of the Department of Treasury. Refer all requests for tax return information to the Office of Public Disclosure, Office of the General Counsel, for processing (see http://sharepoint2007.ba.ssa.gov/ogc/employee... and Disclosure for contact information).

2. Requests from members of Congress

a. Requests based on inquiries from subject individuals

SSA has established a routine use allowing disclosure to a congressional office in response to an inquiry from that office made at the request of the subject of a record. The routine use allows disclosure when a member of Congress or his/her staff needs information to answer an inquiry from an individual about his/her own records.

Inquiries about non-tax return information need not be in writing, but the member of Congress or staff must indicate that the inquiry (written or oral) was from the individual him/herself.

Tax return information may be disclosed only with the written authorization of the individual. SSA must receive the written inquiry within 60 days of when the individual signed and dated it (see GN 03305.001B.2.b. and GN 03320.010B.2.)

Information may be disclosed from any system of records containing the applicable routine use (see http://www.socialsecurity.gov/foia/bluebook/b... ).

NOTE: Although inquiries are not required to be in writing, a written request is preferred. See GN 03314.045 for instructions relating to requests from State legislators.

b. Other requests

•A member of Congress may contact SSA about a third-party inquiry from someone other than the subject individual.

If there is an indication that the third party is acting on behalf of the subject individual, the member of Congress is told that SSA will disclose the information only if the individual consents in writing.

If the inquiry came from an attorney or other authorized representative on behalf of the individual, consent must be given only by the individual or other qualified party listed in GN 03305.005. The consent of the representative is not sufficient.

•If there is no indication that the third party represents the subject individual, or if the inquiry involves tax return information needed for a purpose other than an SSA-administered program under the Social Security Act, the member of Congress is told that SSA cannot disclose the information without the individual's consent.
