Hmmm. Interesting. I have to admit that I did not know the difference between "hijacking an automobile" and "carjacking". Obviously under those guidelines..."The defendant does not have to indicate a desire to injure the victim if the jury can infer that, if the victim had refused to give up his car, the carjacker would have harmed him"....it is very likely the federal court will agree to try the case but, IMO, very unlikely they will go so far as to hand down a death penalty verdict for the first time ever in a carjacking case. Especially given the fact that Capital punishment is forbidden in the state where the crime was committed. Personally, I find it hard to justify the death penalty when the murder isn't premeditated. We'll just have to wait and see.
