'Theft of power' lands electric-car driver in jail

A father in Georgia was arrested, jailed and charged with theft after he plugged his electric car into an exterior outlet at his son's school for a quick charge totaling about five cents worth of "juice." WXIA's Doug Richards reports.

A Georgia man found himself in handcuffs after charging his electric car outside a middle school where his son was playing tennis in what police alleged was unlawful “theft” of county power worth roughly five cents.
Kaveh Kamooneh, of Decatur, said he was attending a Saturday morning tennis practice session for his 11-year-old son on Nov. 2 when he plugged in his electric car at a power outlet outside Chamblee Middle School.
Kamooneh, 50, said he was alarmed when, soon after, he saw a police officer inspecting his Nissan LEAF.
According to a report from the Chamblee Police Department, an officer responded to a called complaint of the white Nissan LEAF left parked and charging at the school. In the police report, the officer said he could not find the vehicle’s owner but found the car doors unlocked and picked up a piece of mail on the car floor showing a Decatur address.

“He told me he was going to arrest me for theft,” Kamooneh said, who said he charged his car for roughly 20 minutes. Clean Cities Atlanta, an electric vehicle advocacy group, says that is roughly the equivalent of a nickel's worth of electricity, WIXA in Atlanta reported.
On Nov. 13, Kamooneh said he was met at his door by police, who handcuffed him and took him to the DeKalb County jail, where he was held for about 15 hours.
“I quickly realized it was from the events that had happened 11 days back,” he said.“The officer did threaten that he would do that. I guess I didn’t quite believe that he would go through with it.”
Kamooneh was officially charged with theft by taking what the officer said was “theft of power” by not seeking permission from the DeKalb County School system to charge his car there, according to the police report.
Police said, according to the report, they met with Chamblee Middle School employees, who confirmed that Kamooneh was not authorized to plug his car into any school socket.
Sgt. Ernesto Ford of the of the Chamblee Police Department declined to discuss the incident further with NBC News, but told WXIA that Kamooneh “broke the law. He stole something that wasn’t his.”
“A theft is a theft,” he added.
But Kamooneh said he believes he committed no crime. He said in his experience as an electric car driver, seeking permission was often an informal exchange and that he had never encountered a problem before.
“Of course I agree that theft is theft, what I don’t agree with is that every taking of something without permission is theft,” he said, adding that there was no one at the school to ask permission from at the time.
The DeKalb County School District said in a statement that it has cooperated with the police investigation and will continue to do so.

A bipartisan budget compromise now appears to have enough support in the Senate to clear a crucial test vote on Tuesday after several conservative Republicans announced their support.

While all the votes are not locked in, Senators and aides in both parties said Monday night they expected to break a filibuster and that the budget would pass later this week.

Orrin Hatch of Utah, Ron Johnson of Wisconsin and Johnny Isakson of Georgia joined four other Senate Republicans who had already said they will either support the bill or, at a minimum, vote in favor of critical procedural motions that require a supermajority of 60 votes to prevail. That should happen if most of the 55 members of the Democratic caucus also vote yes, which is likely.

Sen. Saxby Chambliss of Georgia, a retiring Republican who spent months attempting to negotiate a deficit deal with Democrats, said he would vote in favor of the procedural motions but hadn't decided what to do on final passage.

btw.....Don’t Blame Obama for Bush’s 2009 Deficit

In addition to being theoretically misguided, critics sometimes blame Obama for things that are not his fault. Listening to a talk radio program yesterday, the host asserted that Obama tripled the budget deficit in his first year. This assertion is understandable, since the deficit jumped from about $450 billion in 2008 to $1.4 trillion in 2009. As this chart illustrates, with the Bush years in green, it appears as if Obama’s policies have led to an explosion of debt.

But there is one rather important detail that makes a big difference. The chart is based on the assumption that the current administration should be blamed for the 2009 fiscal year. While this makes sense to a casual observer, it is largely untrue. The 2009 fiscal year began October 1, 2008, nearly four months before Obama took office. The budget for the entire fiscal year was largely set in place while Bush was in the White House. So is we update the chart to show the Bush fiscal years in green, we can see that Obama is partly right in claiming that he inherited a mess (though Obama actually deserves a small share of the blame for Bush’s last deficit since earlier this year he pushed through both an “omnibus” spending bill and the so-called stimulus bill that increased FY2009 spending).

It should go without saying that this post is not an argument for Obama’s fiscal policy. The current President promised change, but he is continuing the wasteful and profligate policies of his big-spending predecessor. That is where critics should be focusing their attention.

As many as 135,000 individuals enrolled in federally funded programs for people with pre-existing conditions will be given a few more weeks to find replacement coverage for next year through Obamacare's health insurance exchanges, the Centers for Medicare and Medicaid Services announced Thursday.

The Affordable Care Act established the $5 billion Pre-Existing Condition Insurance Plan (PCIP) in 2010 as a bridge to the exchanges, and the program was set to expire at the end of this year. But given the ongoing difficulties in using HealthCare.gov and several state-run health insurance marketplaces, concerns have grown that these sickest beneficiaries could find themselves uninsured next month, which could disrupt their medical care and expose them to extraordinarily high costs.

Under the policy announced Thursday, PCIP beneficiaries in 40 states and the District of Columbia, where the federal government operates the program, would have until the end of January to enroll in new coverage via the health insurance exchanges. Ten states run the program for their residents on behalf of the federal government and would have to sign off on the extension, according to the Centers for Medicare and Medicaid Services.
