"The term 'agricultural storm water discharge' was not and has not been defined in the statute" covering permitting, Bailey wrote. "The fact that Congress found it unnecessary to define the term indicates that the term should be given its ordinary meaning."
The EPA initially threatened to fine Alt if she didn't seek a permit for her farm, which it called a "concentrated animal feeding operation." After Alt sued last year, EPA withdrew the fines. In March, it offered to dismiss the case.
But the American Farm Bureau Federation and the West Virginia Farm Bureau joined Alt in keeping the case alive, arguing it had economic implications for farmers nationwide.
Bailey agreed, noting that the EPA had imposed virtually identical requirements on two other West Virginia poultry growers and one in Virginia. The judge also said the agency hadn't changed its underlying position that some chicken farms are concentrated animal feeding operations.
That would mean the EPA can require them to obtain permits they've never previously needed.
The Justice Department, which represented the EPA, said it is reviewing the court's opinion.
Cheers went up in a staff meeting when the West Virginia Farm Bureau got word of the ruling.

Pretty simple. The State Department issued a Travel Advisory for Pakistan in 1981 regarding updated visa requirements. Those warnings are advisory only. Americans could still freely visit the country. Pakistan was not on any State Department travel ban list for U.S. citizens. It's just another one of those conspiracy theories you love so much.

Failure wasn't an option, because any delays would be a political win for the other side, you see, and we can't have that. IF O'bama's behavior during the government shutdown - ordering sites, memorials and parks closed to American taxpayers and veterans - and this push to have an obviously non-operable site up and running doesn't prove how petty and petulant this president is, nothing will.

This is just another piece of evidence Obama doesn't have a clue what's going on in government. His only function is to read prescripted messages from a teleprompter and sign documents when he's ordered to by Vallerie Jarrett. He doesn't have a clue what he's talking about or what he's signing.

If the contractor had written the program, instead of stealing it and trying to delete the evidence of their crime, there would be glitches. This is a trainwreck with no survivors because of the complete and total incompetence of this administration.

If there ever was an issue in Black America which should be viewed with non-partisan eyes it is unemployment. Despite counter-charges between Republicans and Democrats that one is more responsible than the other for economic improvements and setbacks, the 40-year statistical record (the Department of Labor has only kept statistics on Black unemployment since 1972) is that neither political party over that time period has changed the reality that the rate of Black unemployment remains double that of White Americans.

Even the supposed Clinton Boom came with costs unaccounted for. Had incarceration rates been factored in (more Black men were locked up in President Clinton’s 8 years than the combined terms of President Ronald Reagan and President George H.W. Bush) the unemployment rate would have been an estimated two points higher.

All of this comes to mind on days like today as I see headlines and numerous tweets upon the Bureau of Labor Statistics (BLS) release of its Household Data Table A-2 which explores the employment status of Americans by race, sex and age. Sure enough I’m being bombarded with the news that the Black unemployment rate has declined from 13.0% in August to 12.9% in September. Never mind that the increase is partly due to the fact that over 120,000 Blacks not counted in the labor force last month have now re-appeared, and will probably disappear again, next month.

For perspective, 11,719,000 Blacks were not in the labor force in July. In August the number was 11,914,000. In September, we were at 11,792,000.

That is different. The purpose of the brief is to inform Congress of what is happening, and why it happened so they can make informed judgments about things like funding.

Obviously, the Democrat plan is to keep the Republicans from knowing what the White House knows, while informing the Democrats.

And you wonder why a lot of people think the Democrats are acting as if they are the only people in the government....
