Three Teens Breaking into Cars

During the early morning hours of April 4, 2009, 42-year-old Roderick Scott was asleep on the couch of his Greece, New York home, just outside of Rochester. He was awakened by some noise outside.

Scott looked out the window and saw three teens attempting to break into his car. He grabbed his gun, for which he had a legal permit, put it in his waistband and told his girlfriend to call 911 before going outside.

When Scott went out, he confronted the youths, who were going through a neighborís car. According to Scott, he told them to stop and wait for the police. The incident ended after Scott fired two shots at Christopher Cervini, killing him.
What Happened? Accounts Differ

According to 15-year-old James Cervini, one of the three, and Christopherís cousin, Scott shot Christopher after the teen yelled,ďPlease donít shoot me, Iím just a kid.Ē Scott, who testified in his own defense, said he only fired after Christopher came running at him in a threatening manner.

Scottís attorney, James Parrinello, argued it was likely Christopher went at Scott to give James a chance to get away. James was already bound by two probation orders and the consequences of being charged with breaking into cars would have been more serious for him.
Scott Originally Charged with Murder

Unlike George Zimmerman, Scott was immediately arrested after the shooting and charged with murder. A grand jury later reduced the charge to first-degree manslaughter. The jury deliberated for about 19 hours before rendering a verdict of not guilty on December 18, 2009.
Manslaughter and Self Defense in New York State

Under section 125.20 of the New York Penal Law, first-degree manslaughter is defined as when a person intends to cause serious physical injury to another person and causes the death of that person or a third party. First-degree manslaughter also applies to cases that would otherwise constitute murder but the defendant, at the time the act was committed, suffered from extreme emotional disturbance.

It is clear that at the time Scott fired two shots into Cervini, he intended to cause serious physical injury to Cervini. He would have had to have been convicted of manslaughter unless the killing was justified.

Under New York law, deadly physical force is defined as the use of force that can reasonably be expected to cause death or serious physical injury. Under section 35.15 of the New York Penal Law, deadly physical force is justified if the person who uses it has a reasonable belief that the other person is using or is about to use deadly physical force against him or her.

In New York, the use of deadly physical force is not justified if the defendant is not in his or her dwelling and they have an opportunity to safely retreat from the situation. The New York Penal Law is similar to the law of Florida in terms of the onus of proof. A defendant need not prove a killing is justified and the jury must acquit unless they are satisfied beyond a reasonable doubt that the killing was not justified.

President Obama: Native American Relations With Administration At Turning Point

Bill John Baker, principal chief of the largest Indian tribe, the Cherokee Nation in Oklahoma, said before the conference that American Indians have been both "well-served" and "hurt" by other administrations, but Obama has "backed up his words with actions that have made a positive impact on the lives of Native people."

"Obama has done better for tribes than the others, except for the Nixon administration," said Ben Nighthorse Campbell, a former Republican senator from Colorado. President Richard Nixon advocated tribal self-determination as official U.S. policy.

With the accomplishments come greater expectations from a people whose rates of unemployment, violent crime, youth suicides, poverty and high school dropouts are significantly higher than in the rest of the country.

"It's two steps forward, one step backward," Campbell said. "No matter what we do, we have to find a way for Indians to be self-sufficient and not dependent on the federal government, except for those services required by treaty in the old days."

The administration still must implement laws Obama signed and fund lawsuit settlements. Also, tribes want to see the administration push legislation through Congress to get around a 2009 Supreme Court decision limiting the interior secretary's authority to accept land into federal trust on behalf of Indian tribes. The decision has held up economic development for tribes.

Salazar told the leaders Friday the court's decision was a "wrong decision" and needs to be fixed.

"We still need improvements in roads, bridges, schools, hospitals as well as addressing the digital, electrical and clean water disparities that hamper development and quality of life issues for our people," Baker said.

Still, Obama has assembled a respectable bragging list.....

...."We should be proud of what we've done together, but of course that should sharpen our resolve to do even more because as long as Native Americans face unemployment and poverty rates that are far higher than the national average we are going to have more work to do," Obama said. He said his jobs bill would help.

Jacqueline Johnson Pata, executive director of the National Congress of American Indians and an Alaska native, said native peoples' enthusiasm for Obama goes deeper.

Obama has embraced Native American tribal sovereignty preserved in the Constitution, court decisions and treaty agreements and made that the foundation for his administration's dealings with tribes, Pata said.

Like former Presidents Bill Clinton and George W. Bush, Obama appointed a Native American to his Intergovernmental Affairs staff. But he also appointed Kimberly Teehee, a member of the Cherokee Nation, as senior policy adviser for Native American Affairs.

In addition, Obama reminded executive department heads and agencies in a November 2009 memo of their obligation to regularly consult and collaborate with tribal officials on policies that impact Native Americans.

"I think we have made strides under the Obama administration the likes of which tribes have not seen for 30 years," said Stacy Bohlen, executive director of the National Indian Health Board. Bohlen is a member of the Sault Ste. Marie Tribe of Chippewa Indians in Michigan.

Letís talk about Trayvon Martin. How do you think your father would have handed the aftermath of the unarmed teenagerís death?

Obviously a childís death upsets me and the idea that so much had to be done just to get an arrest really does make the point that this country and African-Americans have to be fully aware of whatís going on around us. We have to know and understand the laws and how they pertain to us and fight those that donít support our rights. Itís also important to understand that my father would have reached out to both the Martin family and to [shooter George] Zimmerman in a situation like this. He would have extended his hand to both to begin the healing because we have to heal in order to move forward. Daddy fought for both justice and peace so he would have cared about both families and worked with both families to bring them to a better place in a very tragic situation.

George Zimmerman was found not guilty which outraged a great number of people. How do you feel?

I understood the reason behind peopleís anger since I thought evidence was there to show that Zimmerman was responsible for this young manís death. Manslaughter certainly seemed very reasonable. But with my law background Iím not sure the prosecution did all it needed to do make the case and I donít understand why. There were many issues from that night that werenít addressed and many statements about young black men that werenít rebutted by the prosecution. That was bothersome, as was the District Attorneyís upbeat demeanor after the verdict. I thought it was totally inappropriate and made you wonder if there wasnít some kind of arrangement in the end. Iíve never seen a DA so upbeat after losing such a high profile case.

I don't care what the circumstances, if a blackman shoots &, kills anyone, he will be charged &, face a trial. The cases are identical if not for that 1 gigantic difference!
