A U.S. Court of Appeals for the Fourth Circuit (VA, MD, NC, SC, WV) three-judge panel has ruled that a school district did not violate a student’s First Amendment free speech rights by prohibiting her from wearing a T-shirt depicting the Confederate flag, and from wearing other protest shirts. It also rejected the student’s Fourteenth Amendment claims that the school district’s middle school and high school dress codes are overbroad and vague. In addition, the panel held that the dress codes do not violate the student’s Fourteenth Amendment equal protection rights because they are viewpoint neutral.
