IF IT BOGGLES your mind that George Zimmerman, a 29-year-old with a gun, could be acquitted after pursuing — and killing — an unarmed 17-year-old, here’s another brain teaser: How could Marissa Alexander, a 31-year-old mother of three, receive a 20-year prison sentence for firing a bullet into a wall near her abusive ex-husband, even though no one was harmed?

It’s true. Florida is one of the worst places to fire a gun into the air, even as it appears to be one of the best places to actually shoot at a person.

Zimmerman verdict highlights problems in Florida law

THERE’S NO doubt where moral responsibility for Trayvon Martin’s death lies: with George Zimmerman, the neighborhood watch volunteer who shot the unarmed teenager to death in Sanford, Fla., last year. Zimmerman had no good reason to be following Martin in his vehicle, and disobeyed a 911 dispatcher’s instructions by getting out to pursue him. Yet a jury’s decision Saturday to acquit Zimmerman on a murder charge — and even on a lesser manslaughter charge — was a sadly predictable outcome of how the laws governing the case were designed. Florida should amend its statutes accordingly.

Guilt beyond a reasonable doubt is an appropriately high standard for a criminal conviction; when prosecutors put forth muddled evidence and seemingly unprepared witnesses, as occurred in the Zimmerman case, the system properly inclines toward finding a defendant not guilty. What’s dismaying, however, is how easy it was for a Florida court to accept the claim that Zimmerman killed Martin in self-defense. The overarching mindset is exemplified by the state’s much-criticized “stand your ground” law that undergirded police investigators’ initial decision not to charge Zimmerman; promoted by the gun lobby, the measure relieves people of the obligation to flee from danger before using deadly force. In the end, the Zimmerman verdict reflected a broader willingness to accept the defendant’s subjective judgment that he was in physical danger — and never mind how that danger came about — as sufficient reason to shoot.

In this frontier mentality, besieged individuals have the right to use force against their enemies because there’s no one else to do so. But a gated community in Florida isn’t the Wild West, and this legal framework promotes a kind of vigilantism that is especially dangerous in a diverse society. Zimmerman’s suspicions of Martin, who was black, seemed to be based at least partly on the teenager’s race. Zimmerman’s acquittal reflects a presumption that, in Florida, one can pick a fight with a stranger for entirely dubious reasons, and if that stranger seems to be gaining the upper hand — as Martin did, in Zimmerman’s account — it’s acceptable to pull out a gun and shoot.

In other areas of the law, a person who creates a situation bears at least some responsibility for injuries that result from it; it’s possible that Zimmerman will still face a civil wrongful-death suit. Yet criminal law must now address the danger — heightened in a “stand your ground” era — that one person will draw another into a physical confrontation and then use a feeling of danger as pretext to shoot.

Conservative pundits who predicted mass rioting would follow a Zimmerman “not guilty” verdict have demonstrated how out of touch they are with understanding the pulse of America. In what could be the worst forecast since Fox News’ political pundit Dick Morris confidently predicted a Romney landslide in 2012, right-wing blowhards who ginned up fears of post-verdict urban race riots, have once again shown they do not have a clue about how ordinary Americans think or act.

Thirty-six hours after the verdict and still no American cities have burned to the ground. The Alex Jones, Bill O’Reilly and Rush Limbaugh followers must be so disappointed. Urban riots would have confirmed their paranoia about inherent black criminality, the very same paranoia that enabled George Zimmerman to stalk and kill Trayvon Martin. Riots would have given them a chance to indulge in their fantasies of fighting a race war and unrest would have given them an enhanced license to kill. They could have each become judge, jury and executioner in a Second Amendment dystopia where they could shoot at anything “darker than a paper bag” for sport. Once civil order broke down, they could invoke “Stand your Ground” or self-defense and kill with impunity, knowing full well their murderous intentions could be masked with cries of “self-defense” against black looters and rioters. The only problem was the riots never came.

It was not for lack of effort on the part of the far right though. Alex Jones’ Infowars site posted the dire apocalyptic predictions of ex-Chicago police officer Paul Huebl who proclaimed with near certainty that a “not guilty” verdict would lead to America experiencing its worst race riots ever…

Pat Buchanan opined that “the public mind has been so poisoned that an acquittal of George Zimmerman could ignite a reaction similar to that, 20 years ago, when the Simi Valley jury acquitted the LAPD cops in the Rodney King beating case.”

Yet despite Buchanan’s best efforts to poison the public mind, no such riots materialized. Other pundits, like Bill O’Reilly and Rush Limbaugh were less hyperbolic, but they too raised the specter of urban race riots. Apparently the same white conservative stereotypes of black criminality that lead them to believe an unarmed black kid is by default a gangster thug, also lead them to believe that a Zimmerman acquittal would automatically spark vicious race riots, with the default assumption that urban America is populated with gangster thugs just itching for an excuse to destroy their communities. However, as it turns out it was the right-wing armchair revolutionaries who were chomping at the bit for the chance to engage in lawlessness as riots unfolded.

....While the right-wing tries to play off of fears of urban black rage to scare Americans and to justify their barely disguised racist ideology, the best they can offer is a bunch of footage of white people from the Pacific Northwest thousands of miles away from Sanford, Florida acting silly. If the right-wingers want a riot, they will have to start one on their own, because right now the rest of America is not so much interested in rioting, we are more interested in justice.

Both Obama and Holder are whistling a happy tune while the nation is going crazy. That was their intent. Wouldn't surprise me in the least.
