Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.
All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life.
Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. No official immunity or privileges of rank or position survive the commission of unlawful acts. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.

A New York state judge has fined a Brooklyn-based birther activist and ordered him to pay $177,000 for a lawsuit he filed to have President Barack Obama removed from the 2012 ballot.

New York State Supreme Court Justice Arthur Schack called Christopher Earl Strunk's lawsuit "frivolous" and ordered him to pay $167,707 in attorney costs and a $10,000 fine for a 2011 lawsuit he brought against Obama and the state Board of Elections, the New York Daily News reports. Strunk, who has been allied with "birther queen" Orly Taitz, has filed a series of state and federal lawsuits against Obama. The state Supreme Court is the main trial court in New York.

The Daily News reports:

“If the complaint in this action was a movie script, it would be entitled ‘The Manchurian Candidate Meets The Da Vinci Code,’” wrote Judge Arthur Schack, calling the allegations,“fanciful, delusional and irrational.”

When the judge dismissed the suit a year ago, he blasted birther arguments that contend Obama isn’t a natural-born U.S. citizen.

Schack also mocked Strunk for claiming a “massive conspiracy to defraud American voters (that) was perpetrated by hundreds of individuals, at the behest of the Roman Catholic Church and especially the Jesuits.” He imposed the fees for three law firms that opposed Strunk’s lawsuits.

Connecticut legislators are expected to pass sweeping gun-control legislation on Wednesday, becoming the third state since the Dec. 14 shooting in Newtown to do so.

But until recently, it wasn’t clear whether any legislation would even come to a vote. Connecticut has several strict gun laws in place — it was one of the few to pass a state assault weapons ban in 1993. But in recent years, the state’s pro-gun groups, using grassroots and legislative pressure, have killed two major pieces of gun-control legislation in a coordinated offensive. They strongly opposed any new laws after Newtown.

This time, though, something was different.

Local residents in support of gun-control began turning up at hearings that were once largely attended by gun advocates.

Barack Obama will return 5% of his salary to the US treasury in a show of solidarity with federal workers affected by $85bn in government-wide spending cuts.

Hundreds of thousands of workers could be forced to take unpaid leave if Congress fails to reach an agreement soon to undo the cuts, which came as punishment for the inability of the Obama administration and Congress to come up with another way to address the country's debt.

The 5% that Obama will hand back mirrors the 5% cut that domestic agencies took when the reductions went into effect. The Pentagon's budget took an 8% hit.

Every federal agency is grappling with spending cuts, which the White House has said could affect everything from commercial flights to classrooms.

A 5% cut from the president's salary of $400,000 (£265,000) a year amounts to $20,000.

"The salary for the president, as with members of Congress, is set by law and cannot be changed," Obama's spokesman, Jay Carney, said on Wednesday. "However, the president has decided to share in the sacrifice being made by public servants across the federal government."

The Mingo County WVA sheriff was murdered execution style yesterday the gunman was later shot by a deputy and hospitalized. Recently elected, Sheriff Eugene Crum had declared war on the County's pill mills and Oxycontin trade.

Mingo has also been profiled on Realty TV.

Per capita, Williamson WVA-KY makes Chicago look like nursery school.

Heller that protected the right to possess firearms.

“Some [limitations] undoubtedly are because there were some that were acknowledged at the time,” he continued.“There was a tort called a “frighting” which if you carried around a really horrible weapon just to scare people, like a head ax or something, that was I believe a misdemeanor. So yes there are some limitations that can be imposed, what they are will depend on what the society understood were reasonable limitations at the time.”

DENVER — Authorities investigating the death of Colorado's prisons chief told law enforcement officers Wednesday to be on the lookout for two known associates of a white supremacist prison gang.

James Lohr, 47, and Thomas Guolee, 31, aren't being called suspects in the death of Colorado Department of Corrections chief Tom Clements, but their names have surfaced during the investigation, El Paso County sheriff's Lt. Jeff Kramer said. He wouldn't elaborate.

Louis Taylor Set Free In Arizona After 40 Years In Prison, Enjoys First Day Of Freedom

PHOENIX — Louis Taylor broke down in tears Wednesday as he described how he spent his first hours of freedom after more than 40 years in prison for a hotel fire that killed 29 people: an evening hike and some fast food.

He struggled to operate what he called an "Apple telephone" and said he was more familiar with 8-tracks than modern technology.

Taylor was released Tuesday after doubts about his conviction surfaced and he agreed to a deal with prosecutors that set him free. He pleaded no contest to each of the nearly 30 counts of murder against him in an agreement that allowed the judge to sentence him to time served.

While he has consistently maintained his innocence, Taylor said he took the deal because he wanted out now instead of remaining in prison for years more to seek vindication at a new trial.

What is the "penalty" you guys keep imagining?

There are a few things being proposed that would have potentially either prevented or lessened the severity of Sandy Hook, or at least given people more of a chance. There are no guarantees, but we would be idiots to not try to do something. Are you an idiot?

First, limiting each reload to 10 rounds. Some numbskull will say a trained shooter can reload so fast it won't matter. That's nonsense.#1 Most of these mass shooters are not particularly well-trained. They're kids.#2 The guy in Tucson was stopped in that few seconds it takes to reload.#3 Reloading apparently makes a jam more likely (which happened in one of these cases, I don't remember which.)

So if, in Sandy Hook, the guy had to reload 14 times to fire his 150 rounds instead of just a few times, there is *a very good chance* fewer children would have died. Maybe he would have never made it past the first classroom. Maybe the extra few minutes would have given the police a chance to get there and blow his head off. If you don't think those maybe's are worth it, ask the parents of the very last child who got shot if they think it's worth it.

If you are against even trying to address this, you're a gun-obsessed mental case or a rabid anti-Obama lunatic. No sensible person is against background checks. If you're a normal gun owner who had a background check when you bought your gun, then you would want everyone else to have to do the same thing you did - for your own protection!

Limiting ammo and crazy military guns is SMART and does not in any way infringe upon peoples' second amendment rights, which were written out when people had guns that in no way resembled AR-15's.
