And a slight plurality of Democrats—48 percent—say Christie should be re-elected, compared to the 43 percent who oppose his bid for a second term.
The poll’s margin of error is plus or minus 2.9 percent.

You forgot to reference the requirements in the Constitution for the type of government a state must have to be accepted as a representative element in the federal republic.

How did the legislators that remained loyal to the federal republic violate this clause, thus making themselves ineligible to petition the federal republic to create the state of West Virginia from lands previously in the state of Virginia?

If you cannot show how Article IV Section 4 was violated, then you have no argument to support your contention that West Virginia was admitted into the union unconstitutionally.
