The very concept of compromise becomes a laughable idea, a joke, when a Liberal brings it up to use against a Conservative.

udicial Watch Files Brief Opposing Government Stonewalling:

Justice Department “has disparaged the public’s right to request records of its government”

(Washington, DC)–Judicial Watch announced today that it filed a brief on January 15, 2013, in response to an Obama Department of Justice (DOJ) motion to indefinitely delay consideration of Judicial Watch’s Freedom of Information Act (FOIA) lawsuit seeking access to Operation Fast and Furious records withheld from Congress by President Obama under executive privilege on June 20, 2012 (Judicial Watch, Inc. v. U.S. Department of Justice (No. 1:12-cv-01510)).

Rather than respond substantively to Judicial Watch’s FOIA lawsuit, the DOJ argued in court that the lawsuit should be subject to a stay of proceedings because it is “ancillary” to a separate lawsuit filed by the House Oversight and Government Reform Committee against the DOJ. The Court “should let the process of negotiation and accommodation [between the House Committee and the DOJ] run its course, and then decide with the input of the parties whether and how this action may appropriately proceed at that time,” the DOJ argued, effectively abrogating the FOIA. The Obama DOJ even suggested that the Judicial Watch litigation might encourage the Congress to fight harder to get the same documents in separate litigation.

Judicial Watch counters that FOIA demands a response and that its lawsuit is more straightforward than the House lawsuit and ripe for consideration on its merits. A decision on the House Committee lawsuit, meanwhile, could be delayed for months, if not years:

This notion that [Judicial Watch’s] lawsuit is in some way inferior [to the House lawsuit] is simply incorrect.[Judicial Watch] has as much of a right under the law as the House Committee to seek access to records of Defendant. In fact, since Defendant does not challenge [Judicial Watch’s] claim on jurisdictional grounds, it could be reasonably argued that [Judicial Watch’s] right is greater – it is certainly clearer and simpler – than that of the House Committee…Whereas [Judicial Watch’s] FOIA lawsuit is ripe for adjudication on the merits, the House Committee suit could be months, if not years, away from reaching the same stage.

The DOJ also argued that Judicial Watch’s lawsuit might somehow interfere with negotiations between the president and Congress. Judicial Watch countered:“Regardless of any potential resolution in that case, Defendant in this action will still be required to satisfy its obligations under FOIA, including justifying its withholdings.[Judicial Watch’s] lawsuit simply does not vanish if and when the House Committee suit is resolved.”

Judicial Watch concludes:“[Judicial Watch] has a statutory right to the requested records and to have Defendant’s denial of Plaintiff’s FOIA request reviewed by this Court.[Judicial Watch’s] claim is now ripe for adjudication, and [Judicial Watch] is prepared to brief the issues. Defendant simply seeks to delay the date that it must justify its claims of exemption. Defendant has not demonstrated why [Judicial Watch’s] rights should be immoderately and oppressively delayed; it has only disparaged public’s right to request records of its government. For the foregoing reasons,[Judicial Watch] respectfully requests that Defendant’s request for an indefinite stay of the proceedings be denied.”

Fast and Furious was a DOJ/Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF)“gun-running” operation in which the Obama administration reportedly sold guns to Mexican drug cartels in hopes that they would end up at crime scenes. Fast and Furious weapons have been implicated in the murder of Border Patrol Agent Brian Terry and countless others in Mexico.

Congressional investigators, led by Rep, Darryl Issa, Chairman of the House Oversight and Government Reform Committee, have fought to secure records related to the Fast and Furious program, but the DOJ continues to withhold responsive records from disclosure. On June 20, 2012, President Obama made a highly controversial decision to assert Executive Privilege to shield the DOJ’s Fast and Furious records from disclosure. Executive privilege is reserved to “protect” White House records, not the records of federal agencies, which must be made available, subject to specific exceptions, under the FOIA.

The president’s assertion of executive privilege came just hours before the House Oversight and Government Reform Committee voted to hold Attorney General Eric Holder in contempt of Congress for failing to respond to congressional subpoenas for Fast and Furious records. On June 28, 2012, Congress voted 255-67 to hold Holder in contempt.(A number of Democrats joined the vote, while other Democrats, endorsing lawlessness, walked out in protest.) A second vote, 258-95, authorized the pursuit of records through civil litigation in the courts. Moreover, documents uncovered by CBS News seem to indicate that Holder may have perjured himself during congressional testimony, detailing what he knew about Fast and Furious and when.

“It is beyond ironic that the Obama administration has initiated an anti-gun violence push as it seeking to keep secret key documents about its very own Fast and Furious gun walking scandal. Getting beyond the Obama administration’s smokescreen, this lawsuit is about a very simple principle: the public’s right to know the full truth about an egregious political scandal that led to the death of at least one American and countless others in Mexico,” said Judicial Watch President Tom Fitton.“The American people are sick and tired of the Obama administration trying to rewrite FOIA law to protect this president and his appointees. Americans want answers about Fast and Furious killings and lies.”

Judicial Watch separately filed a FOIA lawsuit against the ATF seeking access to records detailing communications between ATF officials and a White House official regarding Fast and Furious.

While the Obama Administration downplays violence along the U.S.-Mexico border, authorities in Texas reveal that Mexican drug cartels have transformed parts of the state into a war zone where shootings, beheadings, kidnappings and murders are common.In fact, drug-cartel violence is so severe that Texas counties along the Mexican border are under attack around the clock, according to an alarming report published by the state’s Department of Agriculture. The agency was ordered by the state legislature to conduct an assessment of the impact of illegal activity along the Texas-Mexico border on rural landowners and the agriculture industry.Texas Agriculture Commissioner Todd Staples hired two reputable military veterans to conduct the probe. One of them is a retired four-star Army General (Barry McCaffrey) who served as Bill Clinton’s Director of the Office of National Drug Control Policy. The other, retired Army Major-General Robert Scales, is the former commander of the U.S. Army War College.The results of their in-depth investigation have ignited outrage among border state officials who are sick of Homeland Security Secretary Janet Napolitano’s reassurances that the border is “as secure as it has ever been.” Just a few months ago, during a heavily promoted visit to El Paso, Napolitano said violence along the Mexican border is merely a mistaken “perception” because the area is better now than it ever has been.The reality is that in the past two years Texas has become increasingly threatened by the spread of Mexican cartel organized crime as the enterprises move their operations into the U.S., according to the new assessment. They recruit street gangs and exploit porous borders by using all the traditional elements of military force, including logistics, intelligence and deadly firepower.This has created a sort of “narco-terrorism” which takes on the classic trappings of a real war, the report concludes. “Crime, gangs and terrorism have converged in such a way that they form a collective threat to the national security of the United States.” However, the report points out that “federal authorities are reluctant to admit the increasing cross-border campaign by narco-terrorists.”In the meantime, Texas has become an “operational ground zero” in the cartels’ effort to expand into the U.S. This has put residents of border communities in the crossfire of escalating violence resulting from conflicts between cartels, paramilitary enforcement groups and transitional gangs struggling for control of drug and illegal alien smuggling routes into the U.S. from El Paso to Brownsville.Incredibly, Napolitano proclaimed that “some of America’s safest communities are in the Southwest border region…” during her spring visit to El Paso. She actually said that “misinformation about safety” was negatively impacting border communities by driving visitors away and hurting local businesses.

Islamic terrorists—including two al Qaeda affiliates indicted last year in Kentucky—have entered the United States legally through a resettlement program that helps tens of thousands of “the world’s most vulnerable refugees” start a new life in America each year.
Known as the U.S. Refugee Admissions Program (USRAP), it’s a joint venture between the State Department and U.S. Citizenship and Immigration Services (USCIS), the Homeland Security agency that oversees the nation’s lawful immigration. The two agencies are responsible for deciding which refugees are granted USRAP resettlement consideration. USCIS is hands on and conducts individual, in-person interviews with applicants to determine if they meet the refugee criteria.
Most of the refugee referrals are made by the notoriously corrupt United Nations, which has published an extensive handbook on the subject. In a nutshell here is the criteria; a refugee must have a well-founded fear of persecution based on at least one of the following—religion, political opinion, race or nationality. This means there is a continued need for protection and candidates should be granted permanent residence status with access to rights similar to those enjoyed by nationals, according to the United Nations High Commissioner for Refugees (UNHCR) guide.
In fiscal year 2011 Uncle Sam generously offered 56,424 persecuted foreigners refuge and in fiscal year 2012 the number increased to 58,236, according Barbara Strack, the Refugee Affairs Division Chief at USCIS. This week Strack testified at a congressional hearing,“Terrorist Exploitation of Refugee Programs,” that addressed the serious security vulnerabilities in her division. She told the House Subcommittee on Counterterrorism and Intelligence that the Department of Homeland Security (DHS)“has been working closely with interagency partners to improve, refine, and streamline the security vetting regime for refugee applicants and for other immigration categories.”
Last May two Iraqi nationals who were given refugee status under USRAP were arrested and federally indicted for plotting to send weapons and money to al Qaeda in Iraq (AQI) as well as conspiracy to kill U.S. national abroad. The men, Waad Ramadan Alwan and Mohanad Shareef Hammadi, lived in Kentucky and have pleaded guilty to the charges, which are outlined in this FBI document. They are scheduled to be sentenced early next year.
At this week’s hearing, the congressman who chairs the counterterrorism and intelligence committee revealed that the Kentucky case is not a fluke and that the “threat posed by refugees with ties to al Qaeda is much broader than was previously believed.” He reiterated the testimony of FBI Director Robert Mueller before a House Intelligence Committee last year, in which the FBI chief admitted ongoing concerns about individuals who may have been resettled here in the United States that have some association with al Qaeda in Iraq.
USRAP, which has helped relocate millions of refugees over the decades, has come under fire in recent years because it’s gotten too big and security measures are lax. A report released last year by a nonprofit that researches immigration matters says this is because the U.S. has lost control of the program, instead surrendering to U.N. policies to determine who’s admitted and because meaningful background checks are difficult to obtain for refugees admitted from countries without reliable government records.
As a result the program is a bloated disaster, admitting nearly three times the number of refugees as the rest of the developed world combined, the probe found. Additionally, the investigation found that “common criminals, war criminals, international fugitives, and terrorists have all used the USRAP and its related asylum provisions for entry into the United States.” Here is another interesting tidbit:“Bribery of U.N. officials is commonly reported among those attempting to secure refugee admission to the United States.”
