Did Prosecutors Go Too Far In Swartz Case?

Criticism is raining down on prosecutors in Massachusetts after the suicide of computer genius Aaron Swartz, who helped to develop innovations like RSS.

Swartz, 26, had been facing trial on 13 felony charges for allegedly breaking into the Massachusetts Institute of Technology network and accessing millions of documents. Friends and family argue Swartz was the victim of Justice Department overreach. But legal experts say the case is more complicated than that.

Prosecutors in Massachusetts who brought the case charged Swartz with wire and computer fraud, violations of the Computer Fraud and Abuse Act that could have carried more than three decades in prison. Lawyers say even if Swartz had gone to trial and had been convicted, he would have faced about four years or less, given his lack of a prior criminal record.

He committed suicide.

My advice for the president as someone who reads polls: go for it, if it's what you want to do. There is much discussion that acting by executive order would be seen as a "totalitarian" action and provoke a backlash. Nonsense, so long as the order is supporting a measure the public favors.

OATH KEEPERS wrote:
Oath Keepers is a non-partisan association of currently serving military, veterans, peace officers, and firefighters who will fulfill the oath we swore to support and defend the Constitution against all enemies, foreign and domestic, so help us God.
Our oath is to the Constitution, not to the politicians, and we will not obey unconstitutional (and thus illegal) and immoral orders, such as orders to disarm the American people or to place them under martial law and deprive them of their ancient right to jury trial.
We Oath Keepers have drawn a line in the sand. We will not “just follow orders.”
Our motto is “Not on our watch!”
If you, the American people, are forced to once again fight for your liberty in another American Revolution, you will not be alone. We will stand with you.
There is at this time a debate within the ranks of the military regarding their oath. Some mistakenly believe they must follow any order the President issues. But you can rest assured that many others in the military do understand that their loyalty is to the Constitution, and understand what that means.
The mission of Oath Keepers is to vastly increase their numbers. We are in a battle for the hearts and minds of our own troops. To win that battle, Oath Keepers will use written and video testimony of active duty military, veterans (especially combat vets), and peace officers to reach, teach, and inspire our brothers in arms in the military and police to fulfill their oaths and stand as guardians of the Republic.
If you are currently in the military, are a veteran, or are a peace officer, please submit your written and/or video testimony on your oath, so you can help us win that battle for hearts and minds. Your submission may be anonymous.
Guardians of the Republic, fulfill your oath. Join us.

Reality seems to be enjoying a sudden burst of momentum this afternoon, as more Republicans and conservatives are coming out and acknowledging the debt ceiling will have to be raised. The latest: GOP Senator Susan Collins.

Collins spokesman Kevin Kelley emails me:

Senator Collins recognizes that the debt ceiling is going to have to be raised because the U.S. cannot default on its obligations to pay for spending that has already occurred.

Unfortunately, Romney's Mormonism and wealth went against him. He also made the mistake of playing it much too safe during the home stretch and lost much of the spotlight the week after the hurricane and right before the election. He was leading in some polls by as much as 7 points before that happened. Obama was able to take full advantage of looking very presidential.
But the 47% remark was also unfortunate.
In contrast, Obama won on a platform of abortion and free birth control pills.
He's the luckiest man on the planet, I would say.
Fortunately we were spared Romney !

Well, my bad then. Maybe you can enlighten me as to the promises Obama made about immigration that were fulfilled in the past four years. I must have missed it or wasn't paying enough attention.
Then you can rant about clueless folks infiltrating the republican party.
I anxiously await hearing back from you.
Here's some other stuff you might have missed:
Health care reform, an improving economy, ending two wars, removed restrictions on funding embryonic stem cell research with gun control and immigration reform next on the list, all accomplished dragging along a adversarial congress. If Obama does nothing else this has been an incredibly successful presidency! Sure puts to rest the "weak president" argument, doesn't it?

Next withdrawal Afghanistan.
The Presidents next 4 years will be filled with accomplishments; ending the war in Afghanistan, bringing the troops home; Obamacares will be implemented, hopefully with some tweeking, as in resurrecting the public option; an assault weapons ban; reducing the deficit, lowering unemployment rates... should be in good shape for the transition to Hillary!

Exactly. Republicans are going to have to learn how to wear boxing gloves.
But lying isn't necessary. Telling the truth with mind-numbing, relentless one-two punches is all that's needed for a winning strategy.
Romney decided to be the president of the debate team, not the boxing team.
The next republican candidate better start training now.
And who might that be?
Romney was one of the biggest liars who ever ran for President.
After the election; all the pundits were saying that all the anti womens rights talk, the rape comments, the anti immigration stances, the anti medicare, medicaide, social security, anti gay positions were what cost you the election. Lindsay Graham said "we've run out of angry white guys";
That being said; what was the first order of business for Marsha Blackburn? Defund Planned Parenthood.
Paul Ryan: Resurrect his stupid idiotic Personhood Bill
Gingry in GA: Agreed with Mourdoch and Akin re rape comments.
What the hell is wrong with you people? Are you that dense?
However, I digress. Because of the above; we'll all be dead before another Republican gets near the White House. The American people thank you.

When Romney took office in 2003, Massachusetts had a $3 billion deficit. By 2005, the state had a $1 billion surplus, plus a so-called rainy day fund of another $2 billion. When Romney left office on January 4, 2006, the Bay State had a balanced budget plus the rainy day fund — all without ever raising taxes.
“What I think stands out about his relationship with the legislature is he made it a point not to demonize his political opposition,” Eric Fehrnstrom, Romney’s senior adviser, tells me.
“Instead of giving speeches that were critical of the Democratic leadership, he invited them into his office every week for a meeting to discuss their shared agenda for the state. And sometimes there was business to discuss, and when there wasn't, the meeting still took place. They would end up talking about the last movie they saw,” Fehrnstrom said.

NRA supports ban on assault weapons in 1986:

The lone piece of significant legislation related to gun rights during the Reagan administration was the Firearm Owners Protection Act of 1986. Signed into law by Reagan on May 19, 1986, the legislation amended the Gun Control Act of 1968 by repealing parts of the original act that were deemed by studies to be unconstitutional.

The National Rifle Association and other pro gun groups lobbied for passage of the legislation, and it was generally considered favorable for gun owners. Among other things, the act made it easier to transport long rifles across the United States, ended federal records-keeping on ammunition sales and prohibited the prosecution of someone passing through areas with strict gun control with firearms in their vehicle, so long as the gun were properly stored.

However, the act also contained a provision banning the ownership of any fully automatic firearms not registered by May 19, 1986. That provision was slipped into the legislation as an 11th hour amendment by Rep. William J. Hughes, a New Jersey Democrat. Reagan has been criticized by some gun owners for signing legislation containing the Hughes amendment.
