This was on the local TV news this morning. This man was falsely convicted and one charge against him has been dropped. One other charge is still on appear.
As I understand it, two men went to another mans home when one of the two men attacked him. He shot and killed the man he attacked but one bullet hit the man who did not.
The murder charge against the man has been overturned based on Florida's Stand your ground Law. Since he did not mean to shoot the other man I can't see how they can retry him for aggravated assault.
Accidentally shooting anyone is not a crime. If it were, hundreds of hunters would be in jail right now to include Dick Cheney.

Clay County man uses Stand Your Ground defense

"Stand Your Ground is pretty much one of the main conversations that's comes up at the coffee table," said Rick Sichta, a Jacksonville attorney who represents a Clay County man that was recently released from prison thanks to the law.

Jonathan Williams spent the past five years in prison for shooting and killing a neighbor who came to his house to collect a debt. Williams shot a second bullet that ended up in the leg of a bystander. Williams was convicted of second-degree murder and aggravated battery. Sichta says Williams exercised his right to self-defense under Stand Your Ground.

"The Stand Your Ground law is Jonathan Williams' case. Without it, he would be doing the rest of his life in prison."

Last year, a judge overturned Williams' murder conviction, which knocked 20 years off his 40-year sentence. The same judge overturned his aggravated battery charge in November, which is a decision the state is now fighting with an appeal. A decision by the appellate court could lead to a new trial where Stand Your Ground would be center stage again.

"Because he shot and killed the first individual and it was justifiable, the ricochet bullet that hit the second person is also justifiable, and hence that conviction would also be reversed," said Sichta.

That means Jonathan Williams would be a free man again, if Martin's efforts to repeal Stand Your Ground are not successful.

I forgot to mention this last week but last month the Labor Participation Rate was down to 63.6% and this compares to 65.7% for January 2009.
Let me sum this up for you. That is a difference of 2.1% which means that there are 6,573,000 FEWER American employed now than when Obama entered the White House.
You see, the only reason why the official unemployment rate is so low is because 6,573,000 Americans have given up looking for work.
Ya know, if Obama wants to raise $500 billion is taxes, all he has to do is bring the Labor Participation Rate down to the same level it was FOUR years ago.

Ah, but as I have brought to Jacques attention dozens of times before, the bad guys did not have those weapons either. And to protect yourself, you have to have at least the same firepower as the bad guns have.

The supremacy clause only covers federal employees who are doing there assigned jobs.
Case in point was Ruby Ridge. The State of Wyoming filed murder charges against some of the FBI agents but the federal courts ruled that they were acting within the scope of their employment and could not be prosecuted.
However, the U.S. Government was sued for wrongful death and where found pecuniary liable. Again, just like I did Line of Duty Investigations, the FBI will also do an internal investigation and decide if the agent was acting within the scope of his employment.
But if a federal agent goes into a state and violates a state law while he is not within the scope of his employment, he can be prosecuted.
Federal officials are not covered under diplomatic law!!!
