Beware illegal suites and shady landlords

I moved to Nanaimo a year ago and rented a lovely place (online). The landlady sent me many pictures which showed a lovely 3 bedroom (upper) on Deerborne Place. I signed the lease (as she said that rents were set to skyrocket) and prepared for my move from Calgary to Nanaimo.

The land "lady" then promptly sold the house to another woman. When I arrived, complete with moving truck to the house my hopes were horribly dashed. The house, from the outside, looked like a slum...the inside was worse. The photo's had been photoshopped, and the house was filthy. As I stood, crying in the living room, with a truck parked outside that needed to be returned to Budget, I had no choice but to move in. My husband and I set up the computer and compared the pictures - the first landlady had lied and purposefully decieved us to be able to sell the property with tenants.

Not only is the house a dive, but there is no sound proofing. One hears everything from the downstairs (and they hear everything from upstairs). There is not sufficient hot water and so more often then not one cannot bath when desired. Fumes from the basement go upstairs, so that when the neighbour downstairs used toxic spray it came up and resulted in headaches and sickness.

I found out I could take my current landlady to court to retrieve my first months rent (as the previous landlady did not give me notice she was to sell) then my new landlady would have to go after the first one to recover the monies she would be out. I didn't want to do this, electing instead to make the best of a bad situation.

It has been nearly a year and we are finally moving out. It has taken some time to find a suitable house with no illegal suites and one that isn't being rented by a greedy landlord looking for unsuspecting people to pay his/her mortgage 3 x's over.

Nanaimo is filled with these suites. They are illegal, expensive and dangerous. The city seems unconcerned. My new landlady rented out the lower suite to a family with a baby - knowing full well that noise and water are an issue. Seems that making a buck outweighs providing decent housing for people.

If you know of an illegal suite, report it to the city. It is time for this practice to be regulated, and for housing to be made affordable AND safe in Nanaimo.

If it weren't for the illegal suites there would be hundreds if not thousands more people homeless in Nanaimo. There is a reason the city doesn't crack down hard on these rentals, it is because Nanaimo needs them.

In many cases the owners would not make the required repairs to get the suite to code, legal, so there would be less accomodations that are affordable in town.

Good luck changing this fact. Rather than whine about it, change your life and own a home, or deal with the rental market as it stands.

Just to update: My landlord's illegal suite has been reported and she is being forced to make it a decent and safe place to live. This includes updating the electrical, having separate air vents and fire retardant doors between the suites. Don't report all of the illegal suites unless you want Nanaimo's rental market to tighten up even more. Reporting the suites could lead to many being shut down, or landlords will stop renting as the costs are too high to renovate.

If you have major problems with an illegal suite, find another place, but leave that one for someone else to rent. If you report it, that is one more person without a place to live.

Well if you think that doing this is going to make houseing more affordable you are a moron, do you know the costs to make a suit legal.(most likely not) these costs have to be past on to renters in the form of higher rent in order to make it affordable to the home owner.

My god, these places are illegal suites for a reason. So that the cheap ass landlords can take advantage of people that have minimal budgets. The people that argue for the illegal suites are either cheap ass landlords that dont want to put money into their suites or dont want to admit that their loser bastards that are taking advantage of people. Or they are people with minimal budgets who just dont want to pay higher rent but either way there will always be cheap places (that are legal where you wont be screwed over) for people with little money to live.

I have an "illegal" suite - do you even know what it is? I have a family living in my house! It's called sharing. Everybody gets "toxic sprays". I get money to pay the mortgage - oh ya and massive heating bills - the last one was over $400 for 1 month - in Nanaimo! You go buy an apartment building - you go provide affordable rental accomodation - You go get rich so you can help others. You and your toxic sprays ...

If your going to be a landlord make sure you have the lot to pick from and take your time.

Meet them at thier house.
Criminal Record Check.
Working only. Leave the mental patients for street assistance. Welfare is like burning it down without insurance, not worth it.

FRs says it best. I am in a house with an illegal suite and I'm in a year long contract. The tenants in the suite smoke an illegal substance and because the ventilation is shared my kids have to endure these conditions. I have told the owner about the conditions but he thinks the new renters walk on water so he ignores my requests. City now is on it, thank you dch for the lifeline.

illegal suites are dangerous and hazardous to families. so yes report illegal suites its not that hard to upgrade your suite to be a safe place for tenants

Suites are most likely left illegal due to the fact that the D Bag Landlords don't want to pay tax on the income generated with that suite.

You are either a shady landlord or someone who has handme down property (to claim so lacksadaisy just buy a house)
How many people do you know that truly own their houses?
Have you looked at the price of an EMPTY lot these days?
The property holders scooped up en masse as much as they could and now face huge
property taxes and mortgage they want to fulfill with their tenants.
You are being just ignorant to the reality
for many and it goes far beyond your blanket assesment. If you are a baby boomer you are partially to blame
as you had it made as young adult, even with adjustments of inflation there is no way even grouping 5 of your
friends in College could afford the general 2 bedromm rental of today.
Get a grip and wake up and it's not going to get better due to shady landlords like yourself.

Thank you for the link. I have a pompus guy who is not even the owner of the basement apt (he's 70 something)
and he has some sort of agreement with the real owner who he tried to block me from getting ahold of at all costs
and it came to light exactly why.

Aside from all the infactions of not up to code my assumptions came true that this suite was illegal
the day I went to get my mailbox. IT was 3 months after I moved in after the day I had received a package that had a tracking number and I went to his door to get it and he said that nothing had come in the mail. It was not a small envelope I was expecting but a 20" x 20" parcel and it was clearly sitting on his kitchen table. I then stated to him that I have a tracking receipt and it was confirmed that it was succesfully delivered. His story changed immediate and got the package. I had been holding my rent for that month - I was 5 days late at that point due to my suspecting of the suite being illegal and I'm sure that's why he was lying to me. But the lies did not start there. He has lied to me multiple times, even about the most mundane things it's mind boggling. He can barely pay for his truck which he reportedly bought new in 2009 and he convinced some woman to move in with him, undoubtably to help him pay bills and she does the majority of the chores (she is a very kind person and I'm going to inform her of somet hings) he goes on Plenty of fish every day to troll behind her back in the computer in his garage and I've been copying his conversations with a thumb drive) back on track. He tried to bluff that he was going to shut off hydro once I told him I got a case against him going with Housing Authority (costs $50 but will be reimbursed, forced by the courts by him) and he has insulted me flagrantly and threatned me when I try to talk about his problems and I was just trying to share what I know! No accusations just Tenant rights! He wants no part just his scheme. He made it personal so I also just reported him for insurance fraud as he cashed in on some Jewellery he claims was stolen one night they left (I was home downstairs- i would have heard as i can hear their little dog walking around) besides they were not gone the night he claims. So I'm testifying against him in court for that to screw his thumbs to a board. I'm sick of shady people who manipulate kind and somewhat naiive people. I'm kind but no longer naiive. He over charges for rent and even had the nerve to blame me for his recent hike in hydro - but it's the smart meter he agreed to have installed--I mean the owner agreed. He has no say. Since that day all day and night I have left on all lights, turned the stove all day @250 degrees , toaster oven running (I have it on a slab of marble in case it malfunctions and night and leave the fridge door open slightly with air cranked inside. I also have 400w sodium light I hooked up to juice more hydro due to the accusation. So he will get a surprise a month from now. Sounds dramatic but hey, I believe in revenge. He lied and said he put a lein on my car as a threat, among other threats. I had to laugh at that. when I asked the simple question why is it I cannot get a mail box he just say f-u . Really upstanding adults here. I will devote energy to take this guy down. And I won't even flinch. I don't need monetary compensation at all just satisfaction of civil duty. Message to shady -greedy people, we are in for revenge.

That is the fallacy that the Landlord has been getting away with. Passing the costs.
A suite should by law be inspected once a year to copliance.

No ifs ands or buts. WHen you are getting into the rental market you
are pompus , evil and greedy to think the renter should upgrade your investment.
That's wishful thinking and it's all going to come to a head in a very negative way
for the Land-lord.
You are obviously a struggling Landlord .

This is why Tentants are winning with the housing tribunal daily in closed and shut cases.
It's getting worse but I'm profitting of your mistakes. The past year I have taken 3 landlords
to court and won easily due to various but common neglegence. And I wipe my hands of scum.

Yeah but have you protested the dramatic hydro costs? have you protested smart meters? have you tried your hardest to legislate solar and wind power? It's not the fault of ther user they put everyone int his position due to passive attitudes and blaming the wrong person. You have to act before you blame. If you have any device or mechanical slave that burns fuel then you are a hypocrite. And if you don't understand the words I say, then you don't understand how you've been duped but your handlers.

I have to say I liked where I lived until the neighbours upstairs turned off the heat. And I pay the gas. So I told my scumbag landlord to tell them to turn up the heat. At least to 20 degrees since its minus 16 outside. I live in a illegal suite. Getting nowhere might have to move. Had enough of this bs.
