The flood plain land is part of the lands that are still under option. Was discussed and shown on the map last night. Agree it was never disclosed before.
That's a good thing. Land in a flood plain is of no use. Why would those lands even be considered in the original proposal, and mentioned in the Oms? It should have been mentioned that half of the lands are in a flood plain. I don't think any investors would he got in if they knew that.

Oh so quickly we forget. When FROG was first introduced as a project, Roger Baker from NEO was at most of the seminars. Everyone thought he was great and everyone invested. All investors knew that NEO was going to be an agent for FROG. Incase you haven't been reading the FROG updates that have been going out...NEO was the one that got caught, by FROG, with their hand in the cookie jar and refused to pay FROG the money owed for production. It was found that they used the money for unrelated purposes. NEO's involvement with FROG was terminated by FROG and to the best of my knowledge are in litigation to revover what is owed to them by NEO. Read the updates and get your facts straight.
You can get the gist of the NEO counter lawsuit at the monitor's website. It is included in the affidavit filed by Kyle Brown on April 17/2012. It paints a not so pretty picture of the management of FROG with the allegations that NEO states.

That would be all fine and dandy if they put forth accurate information and didn't try to prevent the current management team from speaking with the other 1900 or so investors in Legacy & Airdrie. I am not putting my faith in the 65 investors, give or take a few, who support the UCC. They weren't even able to make a rational decision with the scare tactics and inaccurate informatiion they received from Nicole & Kyle, who didn't have time to go and collect the information that would have been very helpful if they had wanted to work together as a team.
Here is a direct quote from a letter emailed to me on January 27, 2012 from investor relations:
We appreciate that this is a lot for investors to absorb, but we once we have firmed up the
details of the plan we will be holding investor update meetings to explain the restructuring
plan, introduce our management/development team, outline a go-forward plan, and
answer all of your questions.

It seems they were able to contact me without any problems? Took them 2 months to put together any kind of a go forward plan, I guess it took some time to get 5 years worth of dust off of everything. And its been stated the books were not even kept up?? David Murphy stated in the meeting in Red Deer that he had to bring in someone to straighten out the accounting mess to bring it to the point it could even go to the monitor. Anyone out there with a business knows that this is a HUGE concern! Why would we go forward with a management company that won't or can't even do the basics?

Excellent point! While all these books were collecting dust, we were constantly paying exorbitant management fees, and for what? Would they not have to substantiate documentation that support these costs to the monitor. It seems a crying shame to be charged this monthly if nothing is being done.

What were they being attacked for? Can you mention what kind of comments were thrown at the UCC? Could they have been some of Ron's plants doing this?

Buuker, that sound really really bad. There is no way that should have happened.
You are right Danny Boy. Since that post, I got the list of Legacy investors from SK and MN, highlighted all over $10,000 invested and started making phone calls. Turns out 6 of the 7 called (and there a long list yet to call) were sold to by CDS Consulting (Stanzel Bros), all claim they were never told about "eligibilty" rules for Legacy and would not have been eligible.
CDS sold every project Foundation had to offer, for many years and I wouldn't be surprised there are heaps of people who were sold this garbage, unaware of the "exempt market products" rules in NI 45-106.
As Mad as I was about being taken myself, FURIOUS doesn't even begin to describe what I feel now. I have only begun my campaign to nail the seller, since I have no faith anything will ever come out of Founation.*I've beleived that since 2008, when 1) the RM of Rockyview turned down the developement application for Legacy and 2)came realized nothing was happening with any of their other projects as well. All the while, the seller continued to assure me everything was on track.
If anyone doesn't know what I'm refering to about "eligible investor" requirements, and are interested, check out post # 213.
Personally, I wonder how many other sellers used the same tactics.

Yes. Every meeting that's ever been held. I've been told so many times that we're "this close to a deal" or "the papers to sell are on Ron's desk" and always to some mysterious third party that can never be mentioned. Vacancy rates for commercial in Calgary are 3% and we don't have a building, just a hunk of land. This after I was told in 2007 they needed things to "cool down" so it could be built at a better cost. Well...it cooled down didn't it? But did management take advantage of this? Nope. Industrial land around south Edmonton and Nisku is moving well. Are we in a position to take advantage of this? No. No we are not because of poor oversight by management. There is ONE common denominator here. It's Ron and Harvest. Character is measured by what you do when no one is looking. When the investors weren't looking Ron had his hand so deep in the cookie jar it was like he was giving it a prostate exam. Kick him to the curb.
Excellent post! You hit the nail right on the head.

I don't know who the people were and I'm not going to speculate. But there were comments like "show yourself and answer to the investors", and things like that yelled out occasionally. I also felt there was information put forth that was inaccurate or misleading, such as what the intent of the UCC has for the investments, that there are hidden agendas from some members of the UCC, etc. Having read pretty much every document on the monitors site, it was clear to me that some people just didn't have all the information and were saying things that were not true, were making assumptions that had no basis in reported information on the monitors site, or had been clearly laid out in the documents on the monitors site already but that the speaker wasn't aware of.

Ron has made millions off the backs of the people attending. I would say that makes him more answerable than 2 volunteers attempting to shed light on his shady dealings, again, for no pay.

If they didn't want to do the job to answer the investor questions and concerns then I guess they shouldn't have volunteered.

I thought the purpose of these meeting was to hear a go forward plan by current management? It would not have been appropriate for them (UCC) to respond to any jeerers in the crowd. They were there to hear the pesentation not be part of it. They did exactly the right thing not to respond to hecklers. They were there to collect information and analyze it for investors not to partake in the meeting.

I suspect the vocal people attacking the UCC were planted but of course there's no way to confirm that.

Their heckling of the UCC was in extremely poor taste, and ties in with Aitken's type behaviour. Everything he has done to investors over the past seven years or longer) has been in poor taste if not criminal. IMHO

Questions and concerns yes. Heckling and intimidation tactics by plants in the audience with an obvious agenda tied to keeping a crooked manager in place; no.

On that note, I've heard the salespeople are all so loyal to Romping Ronny because they all have backloaded deals tied to Harvest. More investor money heading their way if Ron stays at the helm. Certainly explains why they are all so afraid of some unconnected third party over sight.

I wouldn't be surprised if that were true. Did anyone involved in the 4 CCAA projects get a solicitation email from Investor communications today soliciting your vote? saying that by June or so they will have a go forward plan? Where the hell were all the plans for the past five years. It's not like this mess happened over night. Ron knew this was coming all along and had all of this crap planned a long time ago. What he didn't expect was the UCC coming along. Apparently it is the first group of it's kind ever formed in Canada. Now he's in panic mode trying to cover his tracks because the is a very good chance that with all the evidence presented in Kyle Brown's affidavit the court will award the right to replace the CRO. Then Ronny can't hide everything like he has been doing.

Hey Wise up or wise ass, or coolhead, whoever you are, why haven't I seen your comments on the affidaavit filed by Kyle? Lots of damning evidence in there. It is all fact, no lies just facts.

Did you ever think all this criticism of the UCC and their connections you've put down actually works against you? It defines who you are for sure.

As far as Nicole's apparent connection to Frank Lonardelli, and hopefully Craig Burrows, that's a great thing for UCC and the investors. Nicole's past experiences working as a rep for Foundation is a big plus too for the investors. They have all been inside Ronny's den and know a lot about how he works. Why do you think Ron is so freaked out and scrambling for investor votes. He doesn't like the UCC threat to his power, or the exposure he'll be subject to that he is used to hiding, from insiders who used to work for him. It'll be a real kick in the ass for him.

Best of luck to the UCC in getting the replacement order from the courts!

I must say I really don't get it. In your statement above you said "People on here keep saying its HARVEST Management that spent the money and mismanaged it, NO it's RON and RON alone that did that"
Then you say Ron & Noel are the only ones who can get us out of CCAA. Those statements seem to be a contradiction. So Ron was the one who got us into this by mismangement, but he's the only one who can get us out, with Noel's help?
I'll say this about Noel Winter, from what I have read about him he looks clean (legal wise) and effective and has never been investigated for wrong doing. Saying that, he has been around since 2009. Why hasn't he gotten all this mess sorted out already? He's had three years of exposure to all the projects hasn't he? Are you trying to tell me Noel is in house three years and has been isolated from these four projects until recently?
I welcome your comments Wise up.
YOU DIDN'T READ THE NEXT POST. I said oops I ment DAVE AND NOEL. As for Noel, if you ask him he will explain he was brought in for the FM3 and was dealing with that. He has not been "In House" Before then he was a consultant on the Water issue and was working with balzac to help sort that out. Then in turn it would help the surrounding developments including Airdrie and Rocky View. That's what I understand.

I'm starting the think there are "Plants" of the UCC on this blog.
When then Investors didn't want Frank Lonardelli's beyoud the bond plan, then there was a scramble to get another one in place. Remember Frank just left at the end of Dec 2011. Just over three months ago. That's when Noel and David were asked to look at this and come up with an alternative from Franks plan.

You have negatively effected tens of thousands of peoples lives. With most of our money gone, I can't believe the shameful way you are behaving on here and in your meetings. You will be judged! If not in this life, but the next. I will pray for the poor people whose lives have been ruined because of you.
