It is nothing new they can only go by what your past employers tell them. so instead of sueing DAC/USIS maybe they should try sueing the company they left, either way it is a wasted law suit.

you're right most lawyers won't even take the case.....Alot of Lawyers now represent the companies. OOIDA is a joke too; alot of companies have memberships with OOIDA they get the Land Line Magazine so OOIDA can't sue them. I guess we could all write our 'Congressman' if we voted. |

The problem is DAC/USIS answers to noone. if there was a higher athority you could appeal to, things would be diffrent.

Drivers should always write a 'Rebuttal' and they have to post the rebuttal with the complaint the company wrote against you!! If drivers don't rebutt what was said, that's taken as it's true and you agree with what's there. |

1 actually let me let you on to a little secret.You can sue your company and let me explain how.First off go to your local court where you live and file a slander lawsuit in small claims court, It will cost you no more than 30 depending on the state you live .As you all know usis is governed by the same people who govern the regulations of credit bureaus, experian Equifax and transunion. what you do is write a letter to the attorney general in the city of the company you worked for and file a complaint and mention the slander and by law the attorney general has to investigate it,Second, back to the small claims suit,When you get your court date and you have sent notice to the company you are going to sue ,no matter where you live the company is required to show up and due to cost 9 out of 10 times they won't and this will result in a default and the company will be required to remove what they said about you and you may gain some damages.I really get tired of the garbage out here being spread that you need an attorney! No you don't ! I fix credit reports in my spare time and one of the misconceptions there is that you need a expert to fix your credit report which is untrue!The regulations specifically state that anything put on your dac report or credit report must be 100% accurate or it must be removed meaning if a company says you quit under a load theirs technically no way to prove this and it will have to be removed because a trucking company will not spend 750$ to even investigate this but this is stuff that most drivers don't knw!I went from having 2 bankruptcies and a repo and 25 collections years ago on my credit report to having a 775 crdit score because i made the credit laws work in my favor.On a simple collection thru a credit bureau for it to legally stick on your credit report for instance is from the moment you dispute it thru the credit companies the bureau must investigate if it's accurate which they don't unless you know your stuff and make them but in the legal scheme of things the creditor who you owe must show proof of the debt etc which most never have and the same thing works for trucking companies as many of the false amd misleading things they say can never be 100% proved.I don't charge anything i just want to let every trucker out there know that dac isn't so big and bad when you know what their regulations are and how you can beat them.If anyone needs assistance with how to go about getting a company to remove negative stuff ,give me a shout via email at cameron_shelton@comcast.net |

Good Comments Cameron. 1 question though, the companies are willing to spend some money because they pay dac for the account which I hear is Mandated by HLS. (homeland security). Also most drivers work out of state where they live which can get hectic when dealing with different LAWS and Jurisdictions. |

I am trying to fight a former employer now over a dac situation unfortanatly they are the only ones willing to take me to work at this point so am going to have to work for them at the same time I am takeing them to court. I dont know if that is a good thing or a bad thing but I am sure the courts are going to question why they will have me there if I really did such a thing? So cameron that is all I have to do is file in my local court and write a letter to the Atty gen in there town. I wil try that. Have a great day.
