JC Penney could wind up with empty shelves

New York State Supreme Court Judge Jeffrey Oing told Penney's attorneys on Monday that the chain took a risk by ordering towels, cookware and other products from the company that home diva Martha Stewart founded.

JCP will lose this case based in the fact that their store within a store defense is wrong. If JCP is financing the inventory how is that a store in store concept. What they could have done and still may not have prevaild is have MSLO finance the inventory paying JCP rent.

Macys will likely win, and accept a settlement to end its martha exclusive, let JCP have martha then watch JCP go bankrupt and martha lose ooodles of money.

When the contract was sgned between JCP and martha it still looked like Ron and JCP might do well.

TODAY near everyone knows JCP is headed to bankruptcy and liquidation.........

So macys could lose martha and still win.
