'bad brakes' is not a ticket-able offense. If the vehicle had a valid inspection certificate then it's not the driver's fault.
Re: DWI, if you read the article the police said he exhibited no signs he'd been drinking. Absent probable cause, the administration a breathalyser or blood test would be an illegal search violating your 4th amendment rights.

No you would not of been arrested. you might of been ticketed. Leaving the scene is only a violation if only property damage. If operator returns when police arrive and due not exhibit signs of driving under influence and have valid license and car registration usually no need for ticket. an American wrote: If I had left the scene of an accident to go home I would have been arrested.....why wasn't seinfeld arrested???????

I am not sure I would call him a hero. He did a good job of manuevering the car so nobody else got hurt...but come on, calling him a "hero"? I don't think so.
I am still laughing over the fact that the police said it could have been disasterous if he went into the intersection of 27. How busy is East Hampton in March at 7:30 at night on a Sunday?
