South Florida medical malpractice cases difficult for both sides
It's been nine years since Rita Wax's son died on the operating room table, yet the lawsuit alleging malpractice continues.

My Dad had a routine surgery in Tamarac, the 'routine' surgery nearly killed him and put him in the hospital for 1 year. They then gave him a staff infection. The surgery done was not done correct. The hip ( that was placed in in surgery) had to come out. On taking it out, the 'cocky' doctor had no answers. It was replaced again, resulting in severe bone damage. It had to come out again. The bozo doctor in Tamarac ( well known hip dr.) gave up, my dad became a problem the bozo could not fix.
I took him to a real Doctor at the Cleveland clinic, whom saved his life, repaired the bozo's botched surgery, and he has now regained the use of his leg and hip. The bozo doctor had an assembly line of patients, sometimes doing 6 hip replacement surgery in one day. He only cares about the mighty $$$. He signed off the case, was totally negligent, and couldnt care less about the patient. All I can say, is stay out of Tamarac, go to a real doctor that can stand behind his work, and can actually spend more that 2 minutes with you on the consultation. This Doctor will get his in the end, all the $$$ he makes means nothing, when you ruin lives.. Go to a Specialist, and research the hospitals stats on Staff infections! This hospital in Tamarac has rated the WORST in the county. I could not agree more.. |

There is no such thing as a "routine" surgery.
When there are no Doctors practicing in South Florida people will wake up. But then its to late!!! Why isn't there a malpractice crisis in Colorado?? Tennessee?? Indiana?? Ohio?? Do bad Dr's only come to South FLroida or do scum bag lawyers come here??? |

There are too many mistakes and errors as well as incompetence in the medical field. The only recourse is to sue. It's too bad the caps were put in place. It's hard to find a lawyer who will take the case for the money. Sad but true. My mother died at the hands of some idiot who shouldn't be practicing medicine. But since she was 75, almost every lawyer who looked at the case backed off because of her age. The idea of a long court battle for little money didn't interest them.

What a thinly veiled attempt by the ScumSentinel to CONTINUE to trash the Boca doctors and keep the BocaBabeBoobs case as pertinent as they can. Heeeeelllllllllooooo Sentinel and ms. pensa,,, Kuleba's case IS NOT NEWS any longer. It was a one day story and you've done all you can to help the Kuleba family prove themselves to be a$$clowns and publicity hounds. But, then again,,, this IS the ScumSentinel and you've got nothing better to do. Shame.

Wait a minute!! Malpractice premiums did not go down!!...I wonder where Patty Pensa got that misinformation....probably from the insurance companies themselves who have been making record high profits as they continue to collect exorbitant premiums and fewer lawsuits are filed.
Patty Pensa, writer of this article, check your source for accuracy...you are wrong. Those insurance companies are the real criminals. The lawyers and the doctors are bit-part actors in the game. Fat a#* hospital administrators and insurance company CEOs are the directors and producers here. If a doctor screws up, he or she should be punished severely. |

Why don't Doctors and other medical personnel wash their hands before they touch you. I have witnessed this most times I visit the Doctor. They are disease spreaders that cut corners that make them more business. They know the CDC rules. The know the right thing to do, but they don't do it.

You mean the vast majority of med mal cases are won by the doctor? And you mean plaintiffs lawyers actually evaluate the merits of cases before they spend 3-5 years, and hundreds of thousands of dollars of their own money working on it? And they don't get reimbursed or paid if they lose right? And you mean verdicts are down, but insurance rates still skyrocket?
So if the problem isn't the doctors, and isn't the plaintiff's lawyers, could it be that the DOCTOR'S LAWYERS who ARE paid by the hour (at least $400 per), and who ARE paid whether they win or lose are the problem. If a plaintiff's lawyer can evaluate a case within the first few months of getting all the medical records, why can't the doctors lawyers? If they know the doctor messed up, offer a reasonable amount of money and end it. And if they can't agree on a reasonable amount, the system has many alternatives to going to trial. But that wouldn't pay their bills would it? And if they have a good case, try communicating with the plaintiff's lawyer rather than trying to starve them out. You think a plaintiff's lawyer wants to spend years working on a loser case? Once again, being reasonable will get the case resolved relatively quickly without a trial. Everyone would benefit from this except DEFENSE LAWYERS. They require their lawyers to bill a tremedous number of hours. Raises, bonuses and partnerships are granted only to those who BILL, BILL, BILL. And then they complain about the plaintiff's lawyers. |

We desperately need reform of lawyers. they are killing American society. they sue for every little complaint. now they are suing for artificial turf fields. what is going to be next. we need to term limit the judges and make the loser pay for all cases. only those that are legit will then proceed to trial. there would be a huge drop in all these frivolous cases. why aren't there more malpractices cases in other parts of the US ? that is a good point.

The further you stay away from doctors (and lawyers) the better off you will be. Americans need to start taking responsiblity for their health and fitness. Enjoy a healthy lifestyle!!!

go to myflorida.com and research the treating doctor,just like you would a car before you buy it. See how many complaints have been filed against him or her and why. Also , check with the clerks office of your local courthouse (you can also go online public records search) and obtain the information

a 28 year old trial lawyer has won 28 million in lawsuits. not bad for a kid 3 years out of college. I know doctors who have practiced for 40 years and could not make that much money in a life time.
Talk about putting money on the price of life. How about the next time an attorney gets operated on, we check his bank account and charge him 40% OF HIS NET WORTH TO SAVE HIS LIFE. What goes around come around. |

DIdn't the Kulebas know that the "corrective" surgery would be performed in that setting? Didn't they select the doctor and the setting?

hey dummies. when you cap pain and suffering the tax payer pays and not the insurance company. how long is 150k going to last in caring for a person? when the insurance company funds run out - the cost of care for these folks is shifted from the insurance company to the tax payer. the fl legislature is bought and sold by the insurance companies. they are whores to the bribes known as campagin contributions. the costs of doing business is put on the backs of taxpayers and not the corporate wrongdoers. caps: WHAT HAPPEN TO THE FREE MARKET REPUBLIKLAN WHORES!!!!!

Just want to speak to the lawyers, and particularly the ambulance chasers that seem to flourish here in South Florida.
In 1997, I was 27 weeks pregnant. Thanksgiving weekend, I was having back pains and called the midwife on call to report them. Midwife did not want to leave her Thanksgiving guests to meet me and suggested I was imaging my pains, made me feel like a hypochondriac (I had a history of stillbirth). Long story short, next day my membranes ruptured and my little girl was delivered at 1 pound, 15 ounces. About three months into an agonizing ordeal, driving 1-1/2 hours each way in the driving ice and snow to visit my daughter in the NICU, to deliver breast milk, sometimes sleeping on a cot there if the weather was too bad, leaving my 4-year-old behind with my husband day after day, blood transfusions, oxygen tanks, sleep apnea episodes and finally thank God, now we have a healthy daughter but it was a long road. When we were unsure if our daughter would live or die, we would have liked to file a lawsuit against that lazy, selfish midwife, but a reputable medical malpractice lawyer advised against it. He said the outcome was unpredictable and he did not want to put us through another long nightmare. Thank God for that honest, pragmatic, ethical lawyer. Drop it and move on, Mr. and Mrs. Kuleba. And to their lawyer, do you really want to put them through this, and if so would you completely waive all legal fees and donate them to a worth charity? Otherwise, you are ambulance-chasing scum. You are just prolonging their suffering for your financial gain. Even if you work this case on contingency and then win, the Kulebas will collect a relative pittance after the legal fees and court costs are paid out. Did you not tell them that up front???? |

The legal system exists primarily to grant windfalls to THE BAR, it's most corrupt lawyers and for the judges they pimp......... GEORGE CLOONEY'S movie, MICHAEL CLAYTON shows the lawyers are not seeking TRUTH or JUSTICE...... only a case to fix.

I can only hope you need one of those "Jew" doctors to save your miserable life filled with hatred one day - do you know how they'll react? Just as professionally as if you were a parent or relative. Don't you know hatred is ignorance in action? |
