it sounds like they put your money into the infamous "suspense" fund. They tell borrower to put money in as good faith to show that they are making an effort to get caught up. Then they continue on as planned and foreclose.

AHMS is a ship of evil do'ers that deserve a collective class action of citizens to knock them out of the American mortgage servicing business. We have tried for months to get them to provide us a simple "partial lien release" so we could sell some of our farm land in order to pay our bills. We paid for two appraisals (per their request). The loan to value came back as 80%...which is ideal for both parties. But for some mysterious reason, AHMSI can't provide the release form to our settlement agent. They have the equity in the balance of our farm and home, but refuse to say yes or no. In fact, we have lost our buyer and that smacks of financial damages to our family. Oh, six months ago when this land sale started, we called AHMS (India) and were told, "no worry, the process will only take a week or two and you should call us once you are ready to go to settlement. Three months and county since our first scheduled settlement and $3500 out of pocket in fees to surveyors, engineers, township boards, etc, etc. Let's get a good firm to take these clowns on. Any jury will understand these gross over compensation in lending and mortgage practices. It's time to get lendors thinking logically and with common sense again. Any oh yeah...how about providing attentive service to customers like my wife and me who paid this "organization" over $27,0000 in INTEREST ALONE LAST YEAR. We deserve better. Help!

the securitization documents provide a course of conduct and process for affecting release of title, the "custodian" of the loan files has the authority exclusively to release persons from liability under the note[eg deficiency] or of any ownership interest in the mortgaged property. The custodian is supposed to be the brake if there was a runaway servicer----ie running away with investor money.

The custodian has responsibility for the possession of the note, must authorize its cancellation etc. The problem is that many of these trusts sponsers did not bother to file the list of loans [property address]that are required in the SEC filings and the state UCC filings to create the trusts in the 1st place. Such trusts are pure accounting artifices--failed trusts. The custodian is supposed to have one of these publicly verifiable lists. The fact that the lists were not filed affords many persons a claim on the note and mortgage. The legal authority to release your property now or in future may be fractured. If there is uncertainty as to which trust or owner claims your property, then there is uncertainty as to your chain of title. I will publish a list of the trusts that AHMSI originated/sponsored where the SEC filings went missing. You can only imagine the opportunity that unlisted mortgages present to fast buck fly by niters.

The AHMSI sponsored trusts, as most trusts required the filing of a list of mortgage loans in sufficient detail that a person could verify the presence of his loan in the trust. This was an attempt to prevent doubled sales of the same notes and establish the link that you need to determine if the claimant has the note or merely a list of default loans. A real question is whether an unproven claimant can actually release a home-owner debtor upon foreclosure. This is worsened by the interjection into the puzzle of signers like Korrel Harp--transferring peoples' homes--the sole link between homeowners and trusts with no lists of loans. Why are they entitled to a presumption of truth? We to have had to try to deal with American Home Mortg. agents for weeks and weeks on end. We always ask to speak with someone in the U. S., but are "accicentally" cut off, etc. We have repeatedly insisted on speaking with a supervisor and told it's not possible... We call daily,sometimes numerous calls per day. We can never get the same person, or someone who is aware of the last info we were given on our account. We are so frustrated at the inability of this company to credit our account with a payment they still insist was returned. We have faxed three separate notices from our bamk account verifying sufficient funds etc., and yet our money has still not been credited towards our June pymt. We are told continually that our account is being looked into, call back. We do, and it's still not corrected! We have never dealt with such an inept company. or heard so many different stories each time we call and try to speak with someone to staighten this mess out...Someone has our payment... Where is it.. and why isn't it applied to our account all these past months???? This has been sooo very stressful on our whole existance. What has happened to speaking with someone you can understand, and hear, and is familiar with your account, when an issue arises? Class action suit, Iam with you!

Anna in Falls church-------we are looking over that long site -was off doing more research on AHMIT 2004-4-----found that the 10K eoy 2004 was certified bt Strauss in reliance on representations by BNY--Indenture Trustee

This is peculiar to say the least----but then when we go to the series of 8Ks filed throughout 2005, then we find all of them were in fact filed and signed off by employees of BNY too. Even more strange is that the BNY filing adds up the face amount of the outstanding securities to more than $7 billion--twice the sum of the actual column of numbers -and twice the amount of the prospectus

Does anyone have any idea if we can still file a lawsuit or join in a Class Action Lawsuit against Option One/AHMSI. They refused to work withn us on our Loan Modification Requests for two Rental Income Properties. So we filed bankruptcy. They refused to let the mortgages remain in the bankruptcy. We lost the properties to foreclosure in 2008. We were so devasted. My wife is very ill at the time. I was so confused. Finances were tight, but there were many errors on the loan, that we were never able to get them to correct. If anyone knows if we still have any recourse, please contact me [email protected]

Look at Washington Post friday and NY Times Thurs/Wed-----there seems to be opportunity to file some sort of claim due to forged documents in some cases. See a lawyer before statute of limitations runs------

I think the suggestions of setting up regional groups to track state developments and exchange evidence and other info is the only practical way to go---Im in Arlington VA----anybody want to join a working group in this area? or is one here already? lewt me know pls [email protected]

I'm in Oregon. Sorry if I've missed someone's post on this, but what about Escrow Shortage Statements? We got an Annual Escrow Account Disclosure Statement which states that we are short $3250... I haven't a clue as to whether or not this is legit or not - Does anyone know how I verify this amount and whether they are 2x charging me for things I've already paid for?

This has been a terrible nightmare. In spite of paying them ON TIME, every time since our load mod as finalized, they still insist on payments being made via a paper check - the last one was paid on time, but they failed to post it to our account until the 24th of the month - listing the payment as 14 days PAST our grace period (pay by the 1st, with a 14 day grace=the 15th).

They've made it so hard to PAY Them "Properly", it's been almost impossible to get our account's installments credited ON TIME... Fluctuating totals for each month then they hit us up for back "penalties" for the months that we were delinquent while the loan mod was getting assigned and executed... I'm not sure whether we're in trouble or not - But I firmly believe that this is being done on purpose - "make it hard on 'em so they default and we can foreclose" I'm anxious to hear from anyone who has had these types of issues with AHMSI or who can tell us how to check the escrow business and determine if we've been double-charged.
