This sounds like McDonald's hot coffee lawsuit, dumb people getting rich for being dumb. Sometimes I wish I was dumb just to get rich.

It's not about telling the difference it's about that he was told repeatedly it was "diet" and it wasn't. The question is, was D-wood negligent?

I don't believe in lawsuits. I think any monies that come from them, only will cause misery. It is tainted money. But, let's look at the big picture. People need to be held accountable for thier actions. Why was he refused a call for an ambulance? My father is a diabetic and he doesn't carry his stuff with him either.Especially not to a park.He feels his life should not have to revovle around his testing all the time.And for the comment that he must be a 400lb poorly educated man is quite insulting,why would you make that judgement.People who are 150 lbs have hard core sugar problems,and they are even educated people.People are so quick to judge others without knowing the whole story.The news only reports what they want you to know and think.They want us to think this man is an idiot, just in case one of us gets called for jury duty.The park screwed up and should be held accountable.Reguardless if he did not have his insulin or drank the soda even though it tasted funny he is still a human being and by the sounds of it was not treated like one.Put yourself in that position.What if it were your father,mother, or spouse who was going into a diabetic tizzy and you were refused help and had to drive them to a hospital yourself.I think you would be angry and not so quick to call them a idiot.No I do not know this person or condone what he is doing.I am just looking at the whole picture before I pass judgement on someone.

No, because if he were allergic to chicken and I repeatedly told him the chicken he was eating was in fact pizza and he could clearly taste that it was not, AND he asked repeatedly, meaning he was not convinced, then I think the burden to stop eating it was on him.

I do see the park's medical staff probably could have done more but I would need to read the reports myself and review the park's facilities, treatment protocols, equipment and medication availability before coming to a conclusion.

But regardless that's a better source for blame than the waitress or even the person changing the syrup cylinders that got them mixed-up. There's no way there can be an expectation of the possibility of harm from getting the wrong syrup in the wrong machine.

I'm thinking there may need to be an expectation of basic personal responsibility for a person that has a chronic illness such as this - to carry medication and testing equipment with them, to exercise common sense in the foods they ingest, etc.

My final conclusion would depend on the outcome of the investigation into the park emergency response, but overall if the guy lost business or was inconvenienced or injured in any way, it's his own fault.

they need to ask what he ate... it can affect blood sugar as well. I am not diabetic and I can certainly tell the difference in diet coke and regular coke...

My son has type 1 diabetes, along with celiac disease. It is very frustrating when you don't get what you order. It may seem like a small mistake to the server, but it can have severe effects on my son. I do understand how the server may not know that the wrong syrup line was hooked up. I do not understand why Dollywood would not call for needed medical attention. The plaintiff in this lawsuit must also take some resposibility for his own care. Why did he not have insulin with him? We never leave the house without insulin for our son. I would not rely on others to have necessary medical supplies on hand to take care of my son. I always have necessary supplies to take care of both low and high blood sugars. I think both sides did not act in a responsible manner.

I agree with you!There is a big difference in the taste of regular coke and diet coke so this is just another way of trying to get rich quick.Also,if you are a diabetic,you should always have your medications just in case.He is more guilty then Dollywood!!They cant babysit everyone considering how many people visit.Also,had it been and emergency then the paramedics at Dollywood would have called an ambulance!!Get over it Mister!!

Why not phone an ambulance himself? I always have my cel phone and any true businesman would have his as well. In fact, 90% of people will turn around and go home if they realize they forgot theirs. My response would have been to make the call myself, if I was not smart enough to stop drinking the soda I would at least be smart enough to make a call. Heck, even Dollywood would have let him back in for free the next day so no real loss.

He's just letting everyone know how much of an idiot he is. Who doesn't know the difference in the taste of diet or non diet drinks. Some a**hole looking for money. I know he will get something, but I would love to see him get nothing at all. I can't stand people like this just going out looking for a place to sue for a quick buck.

I don't know what type of diabetes this man has, but my son has type 1 diabetes, which is an autoimmune disease. His body fought against and killed off the cells in his body that produce insulin. The only difference between my son and you is that your pancreas produced insulin and his does not, other than the fact that my son is probably a much nicer person. My son is thin and very active. He was five years old when diagnosed. Diabetes does not run in our family. Just remember that diabetes can strike you or one of your family members at any time. Will you be so outspoken about letting them die off if it is you or someone you love?

he must have liked the taste of sugar, if he kept getting refills. Grow and and get some personal responsibility. Dollywood needs to countersue this moron.
