Pacers agree to community service

Two Indiana Pacers placers accepted diversion agreements this morning, avoiding a trial on charges stemming from a bar fight last year.

how predictable -- the Prosecutor's office is chickening out and not going to prosecute. The Pacer players have been given a Diversion Agreement, the ultimate result of which will be a DISMISSAL OF ALL CHARGES. MCPO spent the time and resources to get grand jury indictments, months of time on trial preparation, and at last showed their backsides. They could just as easily have declined to file charges in the first place, but that requires a spine or an inclination not to be a media **** not the current administration's forte. They could have gone to trial, but again, didn't want the black eye of an acquittal they knew they'd get. Tough talk, little men in charge, surrender. The smiles on the Pacer players' faces says it all.

They were never going to be convicted. No one could prove "beyond a reasonable" doubt that they hit this guy. It's a joke that it went this far.

So, the chief trial deputy says the main witness and victim was "never certain" about who hit him? And they filed charges? What a waste of time and money on a media chase. What an incredible statement about prosecutorial professionalism -- we file charges when we aren't certain. All you mopes who get arrested in bar fights, by the way, hold Wyser to his word and get your diversion agreements, and your charges thrown out. Maybe the Star can get some sort of count on how many other battery charges result in diversion/dismissals. According to MCPO policy, battery cases are NOT DIVERSION ELIGIBLE. Apparently unless Wyser and Brizzi need to avoid an acquittal personally.
