OK, so this story is gonna be long but all is true. I warn any and all people who are financing vehicles through GMAC to beg borrow or steal any money needed to pay off their vehicle. Because they will steal it from you even when making payments. Then they will give weeks of anguish trying to find it and find out why it was taken.

Now before anybody jumps down my throat saying "well, you should just make the payments" need to understand something...I WAS!!!

Here's my story.

In April of 05' I purchased a new Chevy truck which was financed through Nuvell, which was a division of GMAC. I didn't have great credit so my payments and interest was high, but not out of my affordability. In Nov of the same year, i was laid off for the winter months. Something I wasn't expecting or anticipating. Things got rough, and I call Nuvell and deferred a payment. All was good. Fast forward to August of of 06'. I was let go permanently due to lack of work. Again, I call and explain, defer a payment and all is good. According to my contract, I am permitted to defer one payment annually. OK, so I get back to work and get caught up. Fast forward to mid 07', I can see the writing on the wall, the company I'm at is floundering and finances are getting rough. We are staying in contact with Nuvell and are now making payments every two weeks because we cant afford the single monthly payment. My monthly payments are about $600, and understand, our bi-weekly payments are not just $50 or $100 to make face, these are $300-$500 payments. We are in fact paying an average of $100 more per month due to penalties and fines. It's rough, but were getting by.

Ok, so now we fast forward to approx. 3 months ago. So we go to make a payment and they claim they can't find my account. After several phone calls, we find out that my account has been moved from Nuvell control to direct control from GMAC. And then the fun started. On or about Nov 3rd, my truck was stolen. I say stolen and not repossessed because I was never told or warned that it was even close to that. In fact, we had made a $500 payment not 4 days previous. We were no more than $300, or 15 days overdue. So of course, the first thing we do is call GMAC.

To begin with, the idiots they hire can't speak a lick of English. But the big problem is they couldn't or wouldn't give me any information. It took a full 30 phone calls, 3 a day for two work weeks, before we could find out how much we owed and how long we had to pay. They give us a number of roughly $2500 USD. What!!! Hows that possible? Well you see, they pulled my 3 deferred payments forward and demanded all current payments plus the next months!!! Now bear in mind, this charge doesn't even include the tow fees and storage!! During these calls, it took us 10 calls just to locate the truck so I could get my personal effects back. I come to learn that the truck is being stored in a city over 50 miles from where I live!!!

So here we are now, over a month later and still no word from GMAC on how long I have to try and make the payment.

Ok so the question is why did you stretch yourself and buy a new vehicle? You will find the key. If you search you will find it.

As I said, it was not out of my affordability. I couldn't predict the failure of my employers. Bu the point was more along the fact that I WAS making the payments.

GMAC-RFC ltd now called Paratus AMC ltd is the worst underhand mortgage company along with their designated company solicitors called TLT solicitors Bristol UK who I have had the misfortune to have taken a re-mortgage and to deal with. A mortgage made in hell was sold to me with their sole intention to trap. In what is evident and in their process of an arm¬ís length mortgage, they enticed my broker to act as a legal intermediary, attempted to place the entire blame on him when it was their company solicitor who was also their agent put together this illegal void mortgage acting in dual capacity on their instructions. I have been trapped by a predatory VOID mortgage and was dragged into court due to their serious failings only to be fobbed off by the Courts of Law who have been put in place to protect victims. As they shed their skins like snakes and change company names and hands to cover and continue to re-sell their companies to cover their tracks. It is very hard to digest the shock of what I have had to go through as a lay person trying to protect my home as I am not giving charity for the next twenty years. I still have not got over this psychologically and will not be able to put this behind me until Justice is served. Home mortgagors are not giving or expecting charity. People like me want to feel secure in our own homes and have equal rights. Prime Ministers come and go and leave a great legacy for their kids and the country. I need help to take this matter further, and cannot do so on my own due to health reasons, as I walked out of the court room knowing I was set up to lose the case. The people of America a beautiful country and mine here in UK deserve more and have been taken for a roller coaster ride by the Bankers. The protection of Human Rights should begin at home and of Homeowners have to be protected at all costs, not forgetting the Democratic right to a fair hearing and neutral grounds to litigate as a litigant in person.
