How can a man be in two places at the same time. This clearly shows that this man is innocent. Disappointing to see that no one in Qld or Australia gives a hoot about this case unlike the case of fergusion. If he was a celebrity it will be all over the news and talk shows. What a joke Australia? For the pilots out there dont you have anything to say. This could happen to you too. Your wings may be clipped one day just like this man. You never know, you may be next?

Legal students using this case study - Why diddent Martens put forward he was not present at the time of the offence if that was the case? PNG CASA pay off for new evidence? Check this case @ Supreme Court Cairns Queensland Australia. File no: CA No 323 of 2006 & SC No 83 of 2006.

Reading most of the publicised information on Martens, he has always maintained his innocence from the beginning of this case. To answer your question, the only legal evidence at that point in time(his Pilot Logbook) that states that he was flying 1000 km away from the alleged offence was disregarded in court. Also there are substantial information that states he was not even there. This was not revealed by the investigating authorities during the case. Ask yourself this question, how did this all come about? There is more to this than meets the eyes? Martens clearly was horrendously framed.

As a parent, we strive to ensure that our children suceeds in life. In your statements, it clearly shows that you have a grudge against your father and his family that you might have encountered in the past and still has. This is very sad indeed!. Its impossible to speak on behalf of all his children as circumstance changes in relationships, for this is your father's business alone and not yours. Martens is in jail for a crime he did not commit. At this moment in time all his family should be supporting him and his children. From what you are stating that the only person that is helping Martens and his 7 children is his brother. His brother should be congratulated for standing by Martens at this difficult time when Martens needs it the most. To have 7 children under his care is not incompetent at all. How many children do you care for?

Does it really take two years to dig up the evidence? Anyone - with any sort of brains would have had that proof ready to go for the trial - not at this late date.

We can't hope to know the truth of this case, but it doesn't seem anywhere near as clear cut as the OP would like us to believe.

A jury of his peers..........dont you think that this will have a conflict of interest in the judgement of this case. Remember the second case was dropped because the girl confessed that nothing happened between her and Martens. Dont forget that both cases was heard together from the beginning.

When you dealing with a case that happened overseas, it could take more than 2 years. Also remember, on reading about Martens case, his passport was confiscated by the AFP, so how can he fly to PNG to retrieve evidence to prove his innocence.
If the alleged crime was committed in PNG, why wasnt the case heard in PNG? and why wasnt Marten extradited?

Seriously - its ALL the way in PNG and it takes two years to track down?? Bollocks. It's more than disengenious to produce 'evidence' after two YEARS and at the same time accuse the AFP for not finding it.

Like I say - we can't know the truth - but the old adage 'where there's smoke there's fire' springs to mind.

Right now this guy's an oil refinery smokestack.

I am aware of the child sex tourism law between the PNG and Australia government and its implication to protect the right of the child and I am 100% behind you there, however gathering evidence from a country/government thats corrupt to the core. Its like drawing blood out of a stone. For a 3rd world country like PNG, Money is everything. Any body can do anything for money. Pay anyone $50 and they will lie for you too.

The guy was on trail in Australia, not a corrupt state. All these arguments work against him as much as for him. Nothing's settled - and this isn't the concrete proof the OP would like it to be.

Martens is very lucky to have people that still supports and care for him. From all the stories about how his case is progressing, they still soldier on. I think their motto will be " The Truth will prevail" and that I believe is family for you. Can you really say that Australia is not a corrupt country, you must be dreaming!. What other concrete proof they are seeking, his pilots logbook states that he was 1000km away on the day of the alleged crime, his pilots logbook was even supported by CASA and DIMIA records. Now why wasnt this submitted in court when the arresting authorities can easier access these information. Ummmmm..........

According to Martens case, the judge himself disregard the legal pilots logbook, which every pilots in the aviation industry holds, what chance his got to prove his innocence......Zilt.
