It doesn't matter. It was a description of the incident not a legal statement. When you merge onto the expressway everyday you are pulling in front of another car but is not illegal.

If the family of the cyclists want to pursue the issue they can. However, they should be weary of other evidence, such as skid marks and incident placement would could prove the cyclists were indeed traveling at a fast rate. The driving records of all involved can be used to prove a record of safe or unsafe driving.

I ride a motorcycle and know I can stop on a dime going 40mph. Knowing the speed limit of this road would he helpful as well.

i never located the driver of the Taurus there at the scene. about this time, police & firetrucks started arriving. i showed police where the driver of the vehicle was & informed firemen of Dominique's condition & the location of the other rider & informed them that the other rider was still breathing & showing signs of life.
after they had control of the scene, i got in my car with my girlfriend & left. but i lied awake almost all night thinking about the awful tragedy i had just witnessed. there were several times that i wanted to go to the hospital & see if i could find any of the people i had seen at the accident scene. i just felt horrible for the families of these two individuals because of the holiday season being near & i could tell that both of the guys were extremely young, probably younger than me.
as motorcycle riders, we know & assume all the risks involved with what we are doing every time we suit up. we also have to assume the actions of others because even if we are doing the speed limit, it is hard for car drivers to judge our speed & distance. anytime this happens it is a tragedy. whether it involved someone being wreckless or not. a life is lost & a family is in distress. a young daughter won't have her dad around for her first day of school or graduation. sure he may have made a bad decision but, we all do at some point. it doesn't mean he deserved to die.
i just want the family of the victims to know (if they should happen to read this), i feel for your loss & my prayers are with you through this hard time. i prayed with a stranger at the scene of the accident last night because she was so distressed. witnessing this put a lot of things into perspective for me last night. i just wish that there was something more i could have done to help save a mans life. i didn't really know what to say to Dominique's friends at the time. i spent the next 30 mins completely silent & taking in everything i had just seen & came to the realization that life is short & you never know when it will be taken from you. not that i had never figured that out, it was just an unexpected reminder.
again to Dominique & the other rider's family, my prayers & deepest sympathies are with you through this time of pain. if anyone could email me with details as to funeral arrangements i would like to send flowers to pay my respects. my email address is:

your #@$$ is in Florida!!! How much farther away can you be? Just because a news article only mentioned the two that were injured does not mean there were not any others riding with them... I also happen to know the victim in the car it happened too. This person it the last person who would ever break the law.. i can asure you she and her family are totally devestated this happened at all....so make sure you do your reseach before throwing accusations and call people uncalled for names!!! Grow Up!!!!

Clay, you said it so perfectly and I remember seeing you there. I would really like to know how the other young man is doing, I have been thinking about him all day.
I live at the front of the subdivision and rushed out of my home to help and got my husband to dial 9-1-1. I checked things out and offered what help I could. It was a horrible accident and I will never forget seeing that man lying on the pavement, lifeless. Very often I find myself looking out my window at the road in tears, knowing that a daughter has lost her father, a mother has lost her son, siblings have lost their brother and friends have lost a friend. It is tragic and very sad.
There are frequent accidents at that intersection. The road is very busy and the speed limit is too high. We really need a traffic light there. I have had a couple of near misses myself. Just two years ago, about this same time of year, a neighbor in the back was struck by an SUV as she was making a left turn into the neighborhood and her car pushed almost into the community sign. She did walk away from that accident with 100 stitches in her face.
To the family, you have my deepest sympathy. We buried my cousin earlier this year due to the same type of accident. He was on his bike, when a woman ran a stop sign and pulled out in front of him, killing him. So I know how you all feel. Needless to say, just seeing the accident scene and knowing that another young man has lost his life, has left me very shaken and emotional. I pray that you will find strength in God to make it through this terrible ordeal.

Thank you. There are people grieving here, me included and I for one can do without the smart remarks. It's been a very difficult 23 hours just trying to grasp the reality that one of my best friends is dead.

If you want to be an ass, go to Youtube and comment on items there. Unless you have something relevant to contribute to this issue, leave it alone.

And to Adjuster who seems confident in his ability to stop on a dime at 40mph, the element that makes "accidents" what they are is lack of reaction time. Despite the claims of witnesses to the bikers riding habits at the time, which can't be substantiated at this time in either direction, if the driver in the car misjugded her turn, leaving an inadequate amount of time for the riders to swerve or brake, than an accident was inevitable. Now ask yourself, how quickly can you stop from 40mph with a milisecond to react?

Look at the photo, it was practically a head on collision, which makes it clear that someone compromised someone else's right-of-way. If the driver of the car was pulling out of her neighborhood, then there's only one way to interpret it: she failed to accurately estimate the bikes distance from her before turning.

Like I said before, and this applies to everyone, take the extra half second to verify; whether it be a car, motorcycle, bicyclist, as it makes all the difference.

First of all....h&%, I went to school with Dominique and second of all ma'am....yeah I live here in Atlanta...I been in Tallahassee for Pharmacy school if you must know...and i am at home right now so who are you to be trying to talk sh*t to a person who knows both of the victims....once again this is not about you sweetie, it is about Dominique and his family...so in the meantime get off yourself and get the story right before you write a couple of lines about my friends!!!!

So Ms. South Carolina....you know the driver uh....well i know the victims and their family members...so maybe if you were out there on the scene you a@$ will be making sense...but you not...so who knows what you are talking about...you on long distance getting info about the accident...and yes no one is perfect so save that sh%# for another news line.....

No need to pray, it was dry wit and humor. However you can spare me your tacky self rightious indignation as it was said with a purpose. Your right, what these two idiots did wasn't funny! Their mindless high speed joyriding along a residential strip resulted in one of their deaths and a lot of suffering.

I'm taking the accounts describing their actions as fact:
"Just bikes racing up and down Macland Highway for the last about 30, it went for at least 30 minutes just racing up and down the street and I live quite a ways back there but you could still hear the bikes just going. You wondered when the police would get here," said Eric Russell.
If you behave like an idiot you tend to get bad results. Say your prayer, but you might want to give thanks that these clowns didn't WAP some innocent kid trying to cross between subdivisions!

In case your unfamiliar with the area, there are very clear and conservative speed limits posted along Macland road. I would imagine that if these thrill seekers were abiding by them then this accident would have been avoided.(Of course how much fun would it be to poke along Macland at 35 mph?)

It might hurt to acknowledge it, but facts are facts. A complete lack of responsibility brought about these tragic results and at least one of their deaths.

Of course I'm not happy that someone lost their life but with any luck one cyclist might learn from it. In any case, I stand by the Darwin nomination.....

My prayers go out to the family and friends of the deceased. This did not have to happen and I hope that this is a lesson learned. Unfortunately, the news media got it right this time, I live in the subdivsion where the crash happened. Starting between 5-6 PM my son and I watched and listened as these bikes went up and down Macland Road DURING RUSH HOUR!!! If at the time of the accident they were speeding coming around the curve, the car that hit them did not have time nor the chance to prevent this from occuring. This was that 1 time out of 10 this was the motorcyclyist fault.
I can hear out my window the different sounds of motorcycles and cars and the revving of these bikes were the same througout the night. There is no way to down play the fact they were not racing. My question is where were Cobb County Police?

As for the "witness" here, I live on Macland Rd and I ride a motorcycle. I can tell you that with the beautiful weather this week, if he only heard motorcycles on Macland for about a half an hour, it was probably many different riders and not just the 2 that were involved in this unfortunate accident. Everyone is riding this week, not just these 2!
LOOK TWICE SAVE A LIFE, MOTORCYCLES ARE EVERYWHERE!!!
