This should be a no-brainer. New Mexico law clearly states businesses can't discriminate based on sexual orientation.

Claiming her photography business is protected under the first amendment because of a "freedom of artistic expression" is a bit of a stretch.

I loved the claim that an African-American photographer could be forced to offer services to a KKK group. That assertion was quickly swatted down when it was pointed out that the KKK isn't a protected class in New Mexico like sexual orientation is.

The appeals court upheld the district court finding, but you just never know what a Supreme Court is going to do.

Wedding photography is a craft and a business , not an art. The defining characteristics are simple: one does not gnerally display commercial wedding pictures in an art gallery or try to seel them to the general public.

If a wedding photographer can claim to be an artist, a technical writer or producer of elevator music could also do so.

FYI- The MN House committe has also passed marriage equality out of committee. Expect a vote in the full House & Senate sometime in April or May once they get the budget done.
