Hey, The City of Lilydale approved this smoking club. The owners received a license to sell tobacco, you need a license to sell tobacco products. That was approved. The City of Lilydale also approved an "Open Bottle" license. What about the building permit. The owner claims he took out a $60,000 loan to create this smoking club. The way the law reads, is that if the city approves the ordinance, the State will go along with it. My question is, who really owns this establishment? This is the old "Diamond Jim's" Mall. The owner of the Mall is who? Wouldn't the owners of the Mall have a say in this? And Moose Country, in the same mall? Hey I know who owns the smoking club! Joe Schaefer and his friends! He must have friends on the city council as well. Keep going forward Joe. We are all watching.

Now the fascist-politicos, do-gooders and media jackals will be swarming down on PA/LSC like whites on rice. What a shame.
This media attention will continue until either a judge rules in our favor and/or the current "Freedom to Breath" act is amended to ban all indoor smoking in non-residential enclosed areas. I fear that the second option is forthcoming. Smokers (of all types) are now considered to be just second class citizens of America. Like Mr. Kaess stated, "It's not about health". It IS about government control the the people. Welcome to the People's Republic of New Calisota!
Who owns the building? What about the other shops in the mall? It is a known fact that smoke travels through heating and cooling vents. What is this doing to their health? Next Schaefer will be asking for a strip joint. Just watch. He obviously has Lilydale in his back pocket. Lilydale is hard up for money, how they ever approved this is beyond me. Your gripe is with the City of Lilydale and Joe Schaefer. Look and see who owns the Mall.

As opposed to the Big Medicine, anti-smoking Nazi's having people like Sen. Kathy Sheran et al and the Minnesota Department of Health in their back pocket?

I don't think the smoke will travel through the heating and cooling vents all the way to Chandler Arizona.

Guess you didn't read closely, it has its own air filtration systems that vent only to the outside of the building, since most winds blow west to east in the northern hemisphere, not much chance of that even getting close to AZ

Hey, don't get me wrong! I am all for the social club. It is a great idea. All I am saying is that these people who do object are barking up the wrong tree. They need to approach Lilydale City Council. And the Nazi's? I don't get the connection. And now being in the season of Passover, let's have some compassion for our fellow citizens. And I don't live in Chandler, AZ. That is where this computer was registered before I made the move, right across the street, from Lilydale Social Club.

But what about the heating and cooling vents? Do they have their own furnace? Was this part of the $60,000 loan?

I predict that, in a relatively short time, it will become illegal to smoke even in your own home, if there are children living there. And if you step out onto your porch or deck to light up, and your neighbor (on either side or across the street) objects, look for that "loophole" to be closed as well. I used to think this notion was absurd, but I can imagine a day when it will be legal to own a cigarette, just not legal to smoke one anywhere, under any circumstances.

And if the tobacco tax revenue dries up, brace yourself for more accusations that your wallet needs to be dipped into some more, because you "aren't paying your fair share."

Oh yes indeedy! The State of Minnesota is more hooked on their tobacco tax revenues than the people who buy 'em and smoke 'em. I'm sure the busybodies from these organizations will be more than happy to raise their hands first when called upon to pay more taxes to compensate for the loss of the other revenues.

NOT.

How about "when will you get it?" The Minnesota smoking ban is for PUBLIC PLACES!!!!! The Lilydale Social Club is 100% PRIVATE. They have No liquor license, NO food license, NO gambling license, they are not a PUBLIC BUILDING. FTBA does not apply here, no more than it does in your home, or any rental if the owner has no objections. The object of the law was to "protect the PUBLIC in PUBLIC places." The club in Lilydale is no more PUBLIC than your livingroom. FYI: Most units in strip malls and other shopping centers do have their own heating, cooling, and ventilation systems. MYOB

You act as if this is private property. The owner of the LSC is renting the space right? It is not his private property.
And if you would go back and read the article, it clearly states that the Lilydale Council approved the "Open Bottle" policy. This is not a garage. I'm not asking if "Most" strip malls but if this one has its own heating and cooling system. Stay in Burnsville where idiots live, you are in good company.

Just an interesting aside. When you search "cigars" (under the NEWS category) on this Pioneer Press website, before you get to this story you will see two sponsored links from online retailers. Compare those prices to what you are forced to pay for cigars in Minnesota. Did you know that the state makes more money per cigar than the retailers do? It's a fact. I write the check every month. Retailers are taxed (a whopping 70% tax, mind you) on DELIVERY...not when the product SELLS. Next time you visit a premium cigar retailer...Perfect Ash, Stogies on Grand, Golden Leaf or Cigar Jones in Minnetonka...look around and appreciate the sacrifice that's been made to give you that selection. Support your local tobacconist.

Most shops in a strip mall will have an individual 'package systems' mounted on the roof for HVAC. To have a duct work system that allowed for the mixing of air from one shop to the next would likely be in violation of numerous health, building, and fire codes...What's your point?

Everyday a right is being taken away from us citizens. There are those of us who see it happening and grow concerned, while others champion those rights being taken away.

There have been many analogies written in these comments regarding Nazi's and the anti smoking crowd. Most of them are comparable expect for the extermination of a group of people based on religious beliefs. But the point has been made that the Nazi's didn't start with the extermination, it started slowly with the rights of it's citizens being taken away, even activities done in the privacy of their homes. When it came time for the Nazi's to begin the rounding up the Jews, the public was so helpless and was at the governments will, their wasn't a way to rise up and stop the injustice that was about to take place. They worked their way up to hauling Jews into trains and slaughtering millions of people.

I know its a terrible comparison, but those of us who see the small steps currently being taken by groups on the Left, we are afraid of what the end objective would be. By then, we as a citizen will be defenseless to stop what the government started.

Learning from history will show us the way to survive.

I confess to a child-like feeling of satisfaction when I walk down the Nicollet Mall puffing on a good stogie. No one has said anything yet, but I sure get the hard stares and disapproving clucks. This pleases me greatly. I am the poster child for everything anti-smokers hate about smokers. Anyone care to join me?

Thanks for explaining this to me. The Pope, in his sermon today in New York said for "the Americans to use their freedom wisely." Our freedom is taken away from us every day. And I know this isn't the right forum, but look where we are headed. Americans take for granted their freedom and I now see the comparison to the Nazis. God Forbid, but if Obama is elected President, we will see the end to our freedom. And America doesn't even see it coming. And we are fussing about a social club which allows cigar smoking. I don't see anything wrong with it, as long as women are allowed to become members (no discrimination), but if it is so private, I would think that it could discriminate against women, race, religion, etc. It doesn't have to follow any laws. Now I see the comparison. Learn from the past? Are you kidding? History keeps repeating itself. Man continues to try to re-invent the wheel, and we just keep spinning and sinking lower and lower.

Your post is reminiscent of a poem I first read back in the 60's, quite ironically I think, in an ad for the ACLU...

First they came for the Jews
and I did not speak out
because I was not a Jew.
Then they came for the Communists
and I did not speak out
because I was not a Communist.
Then they came for the trade unionists
and I did not speak out
because I was not a trade unionist.
Then they came for me
and there was no one left
to speak out for me.
