The cyclist was part of a group of 240 cyclsit travelling from SF to LA as part of the AMGEN California Coast Classic, a fund raising ride for the Arthritis Foundation. The driver was reportedly swerving repeatedly to terrorize several of the cuclist traveeling in single fiel on the highway, and then fianlly swerved and hit once cyclist directly, then sped off. Cyclsits on the scene referred to it as an apparent "road rage" incident. No news on the condition of the cyclist, but the AMGEN group is continuing their ride today from Pismo to Solvang

Aren't there traffic cameras that they can check? Does anyone know how we can reach out to the community to find witnesses? Our prayers and thoughts are with the victim and his family.

How inconsiderate of you Ho De Doo. Is it possible that you are the criminal who hit the victim or know who the criminal? Or may be you think and act the same way the criminal who did this does? I hope you never have to sufer due to the criminal acts of a reckless driver, but if you do it will be well deserved and you will remember your comments.

Get your facts right -- although the ride *does* require us to ride on the highway at times (and, by the way, a bicycle *is* a vehicle and entitled to all the respect given any vehicle on the road, with the law allowing highway riding if there is no viable alternative) this particular incident occurred on a surface street, there was no highway involved.

Peter is 100% correct. In California for sure, and probably the rest of the US, a bicycle is legally entitled to use the highway or freeway if no viable alternative is available. In addition, although where the crime occurred was technically a highway, it could better be described as a normal surface street (with lights, stop signs, etc). The speed limit was probably 35 or 40MPH.

More to the point, however, I don't see how anyone could condone the actions of the driver. Let me put it this way... Are you legally able to aim for a pedestrian that is J-walking? NO WAY! That is murder if you kill the person. Clear and simple. If you believe otherwise then you need to talk to a lawyer before you find yourself in jail (and you will go there). And this driver knew what he did was wrong otherwise he would have stopped, thinking he had immunity.

Morally, ethically and legally the guy was wrong. Pure and simple. Right now I'm guessing he is looking at attempted murder, assault with a deadly weapon, hate crime enhancements (hurling insults beforehand), felony hit-and-fun, and probably a few other things the DA will come up with later. Plus, if he has any assets, the bike rider will surely be able to collect on those too. I sure hope he does because Carlos deserves a new house out of this! Clean him out, Carlos, clean him out...

The fact is that the cyclist - Carlos - was riding in a marked bicycle lane separate from the road way used by cars. The driver moved out of the traffic lane and completely into the bicycle lane in order to hit him!

The section where this occured was not a highway and we were not riding in the traffic lanes - this was a deliberate attempt to kill...

Well, technically I think it was a highway, but not in the sense that most people may think. Many surface streets in various cities within California are technically classified as highways. This is a funding thing and legacy.

In the area of the crime, and I call it that deliberately, 101 is the real "highway." 1 is the historic route that has, for the most part, been replaced by 101. There are many portions of the California coast where 1 and 101 are actually the same road, but not where the rider was hit. For all practical purposes it was just a road like any one can find in every other city or town in America.

In the time I rode with Carlos I would classify him as a safety conscious and considerate rider. He didn't drift into traffic, etc. Although I didn't see the accident, I am willing to bet he was well out of the marked lane. There was a good shoulder on the road.

Don't let a couple bad comments from a vulgar, inconsiderate trouble maker who wasn't there and has nothing better to do but stir up trouble detract from the purpose of getting some information about a good person caught in a bad situation. People who have nothing good to say about this situation shouldn't be given the pleasure of a response or the opportunity to change the focus of getting some information about the facts, he survived and we're praying for the blessing of his full recovery, how's he doing today? Find out more at his church's website for an update on his condition http://sanfernando.netadventist.org/
