sounds like the mayor wants to go into the adult toys sales! whenever he wants he runs someone out of business he sends his dinelli led hench men in to do his dirty work

The city let him open it. Now they're hounding him, for something they let him do in the first place. What did they think was going to be advertised and sold here? Don't like what he's selling? Don't go there, and certainly don't walk by staring at it if you don't like it. It's his constitutional right to chase the "American Dream".
what gives anyone else the right to dog him about how he goes about it. He probably has the permits for it too, and he probably told the city where they could shove it for giving him a hard time about how he went about selling what they gave him permission to sell in the first place. Sounds like the DA's office has gone on one of their power trips again....

This is stupid.

If you want to have a sex store there should only be two real requirements...and these are just ideas...

1) Not in close proximity to a school
2) Opaque windows so your materials aren't seen outside.

Otherwise, if someone wants half their store stocked with videos and dongs, SO WHAT?

Your a Gomer! Its not your constitutional right to chase the American Dream if in doing so you break the law. That's like saying its ok to be a drug dealer. Agreed selling smut is probably (there's a word you like to use) not as damaging as drugs. You make a lot of assumptions about the owner's permits and such. That's a big opinion with such little knowledge of the facts. Ofcourse that's what most of these blogs are anyway, a bunch of people spouting off about things they no little to nothing about. Maybe Marty wants to start his own sex shop so he's running this guy out of business, WHATEVER, that's a stretch and I don't even like Marty. All I read is the zoning ordinance restricts the amount of material he cal sell. Here's a thought; run your smut shop within the law and no one should bother you. Hmmmm that sort of goes hand in hand with a lot of other things people do doesn't it.

Y'all noted didn't you that its not about the ability of the kids to look in the windows as was originally claimed (and it's NOT true, ya can't see squat through the windows).

And its not about them being to close to a school as was originally claimed and kids frequenting the area either.

Now its all about whether 25% or more of the contents of the store are 'adult' items or not!

Not at all, in fact, I think its a great location. Its well lit, ample parking & safe. No sleezy bar next door, its a building away from a main street, and its not cheezy inside. The place is mostly frequented by women, not men.

I know. Call me old fashioned but there is just something very casual about it being right next door there to Hollywood video.

If you don't like smut, don't participate, simple as that. Nobody is forcing you to go inside. Most such places are frequented with people who look like the carneys at the fair, not so at this place. Its tactfully done. You can see the same clothing at Victoria's Secret in Coronado, and nobody is dissing them or hiding them from the kids, and if anyplace draws the kids in Abq, Coronado Mall does.

The complaint states that you can see materials from the street. So in one sense, you are exposed to it, whether you want to be or not, while going to the video store.

Having been there, no, you can't see them from the street, or even from the front of the store. The windows have some manner of reflective shading making it hard to ID anything in the store, let alone the street. Plus a barrier wall inside so all you see is an occasional piece of lingerie and greeting cards. All the adult items are in the back half of the store.

The TV news is where they said the lawsuit was over the 25% adult item threshold as opposed to what was originally claimed when this all first started.
