He was told to leave but S for brains thought that he beez smart. He wasn't arrested for drinking an iced tea, he was arrested because he refused to vacate the owner's premises which is private property.

Nowhere on that video did I see that so called officer produce ID proving he was a police officer....Some lawyer will have a field day in court with this case.....just sayin'.....

Actually YOU STPID FK if he was trespassing, the store owner would have to state he wanted the man to leave and the man fail to leave. That NEVER took place so the charge of trespassing was bull. "The “cop” didn’t need “the consent of the owner”— the STATE owns ABC Liquor Stores, and the “cop” works for the STATE. What the officer did was no different than if some gangsta acting like a fool in YOUR FRONT YARD is asked BY YOU to get off your property. It is against the law in NC to loiter on ABC property. That is posted all over the place. The officer was not impersonating a police officer — as a ALC officer, he IS STATE POLICE. He identified himself as a police officer. That is all that’s required under the law. You read someone their Miranda rights AFTER you arrest them, but before you question them. Not during of before the arrest."

I suppose smh aka aisling aka rut roh (and no telling how many other names she trolls this forum with posting her opinions and spam) would allow someone in plain clothes who SAYS they are a police officer to treat her in the manner the so called police officer in the video treated this man....and NOWHERE did anyone mention Miranda....I suppose her police officer hubby told her this....NOT....smh....

You are not allowed to just roll up anywhere and hang anywhere except your own home.! A business is private property.

And he asked "X" to leave three times.

Bottom line is, a store’s parking lot is private property. If they want you gone, you must leave. They can charge wih trespassing.

Businesses having security and trying to make shopping conditions safe for their customers.

Judging from the video, it's clear that "X" was staging the whole thing.

And somewhere a village...

'IN the video an Alcoholic Beverage Control Law Enforcement officer in plain clothes approaches the man in the parking lot to ask about the beverage. Thursday afternoon the Cumberland County ABC Board Law Enforcement identified the officer as Rick Libero. ABC Law Enforcement identified the man as Christopher Lamont Beatty Junior.

The video shows Libero repeatedly questioning Beatty about the contents of the can. Beatty explains the contents are Arizona brand iced tea, and he keeps the container out of reach of Libero.

Libero asks Beatty to leave the property several times. Beatty hesitates to leave as he asks why he is being asked to vacate the property.

Libero shows Beatty a set of handcuffs fastened to his belt before asking Beatty to put his hands on a nearby car. Beatty moves toward the car before being handcuffed by Libero.

Libero takes Beatty to the ground while Beatty is still holding the can. The person videoing the incident then takes the can from Beatty to show the label closely on camera.

The video shows Libero standing over a handcuffed Beatty until a uniformed Fayetteville police officer arrives. The assisting officer places Beatty in his cruiser.

An unidentified woman hands the person videoing the incident the beverage container and Beatty's hat.

ABC Law Enforcement said Beatty was arrested and charged with trespassing and resisting, delaying and obstructing a law enforcement officer. Beatty was given a $2,000 secured bond. His first scheduled court appearance is June 6."

"This officer is a member of the local ABC (alcohol beverage control) police. In North Carolina all liquor stores are ran by the state through local ABC boards. This officer is a sworn law enforcement officer with the authority to trespass anyone from the ABC property for any reason with the exception of anything covered under the Civil Rights Act of 1964. He did not arrest this person for drinking Ice Tea so stop spreading false information. He told him to leave the property three times and he refused to do so. The case will probably be dismissed but any civil lawsuit will result in summary judgment in the officer’s favor because it was a valid trespass arrest. This rapper does not own the business and has no right to remain on the premises if he is told to leave. He does not need a valid reason to remove him from the property. I would agree that the situation was handled horribly and certainly did not need to escalate into an arrest, but legally speaking this is a valid arrest."

Perhaps this rapper will include the video of the numerous citizens complaining about his loud profanity around children near Cross Creek Mall. Perhaps he will explain how he was using profanity on private property loitering without making any purchases. This video was edited and failed to include some pretty important parts. Do you think this cop just showed up out of the blue? Get real people."

"In nc the A.L.E. or alcohol law enforcement over sees all abc stores. Yes he did have the right to ask him to leave he also had the right to take the can from him to check it out and make sure the contents were not switched with alcohol."

"Dope boys sometimes hang out in front of liquor/convenience stores holding a can of soda or ice tea. The can contains no soda, but is actually the receptacle for the narcotic they are selling. Even the semi-smart ones know not to keep the drugs on their person, so it isn't a frequent thing to find. That being said, this incident was more likely to do with an open container violation, than a drug investigation.

If the officer's agency has authorization to trespass individuals from the property, the arrest seems solid."

"Often times people will mix booze with pop or juice and carry it around in public. The officer could have smelled the odor of intoxicants coming from the man/container (not observable via video) which led him to suspect the guy had spiked his tea. The officer probably wanted to see the can so he could smell it to determine if it was lawful to possess in public."

"I'm going to hazard a guess and say that this guy was one of their 'frequent flyers' and has been a thorn in their side for awhile....with several (or more) arrests for public intoxication and/or drinking in public (which is why he checked the iced tea can to make sure it was really iced tea)

As far as the 'tresspassing' goes, the guy could very well be banned from that location due to past arrests ect....who knows... "

I didn't hear any mentions about the owner having an issue with him being on the premises. Furthermore, he didn't identify himself until later.

The case is rediculous. Hes being put on probation, he's required to do 24 hours of community service, he's being drug tested and he can be searched without a warrant.

I don't get how you could compare him to a "gangsta" when he obviously did nothing wrong. the tresspassing was just something for the punk ads cop to put on him and resisting when he shouldn't have been arrested. I bet if he were white you would have a different opinion. racist like you are what's wrong with our country now

1st it is not private property all liquor stores in NC are owned by the state. Therefore a citizen can be on the grounds of a liquor store because as citizens of NC we own the all liquor stores. Why dont you see it for what it is. This racist power hungry cop used his power to arrest a combat veteran because he saw him as a thug. He risked his life for us and he gets treated like this!

Frequent flyer, Dope Boys.... This man is harned but not a hardened drug dealer....he is a combat veteran of the 82nd airborne unit a former staff sergeant. Two things to note a white lawyer told me this once when he was defending me on trumped up charges. His name is Melvin Roberts former SC state representative. I readily admit that I have no particular love for Black People, I defend you and others in cases like this because the power of the state can be terribly applied. My experience has shown me over my 82 years that, we try out tyrannical practices/ laws like these on the Black and the Brown....and when the white people say nothing. Eventually WE will be treated the same way, because in our silence we have given the state permission. WE white people, abdicate our own rights when we say or do nothing! Eventually the state will treat us the same way.
