Garner was not observed by the police of breaking any law. The police "believed" Garner was selling cigarettes.

The police violated 18 USC 241.

Additionally, the police officer that applied the "ILLEGAL" choke hold have already cost the city of NY $30,000 for improper conduct, lying and false arrest.
