Guilty verdict reached in Vacaville teen rape attack

FAIRFIELD, CA (AP)- A Vacaville teenager has been convicted of raping and stabbing a 13-year-old girl and attacking her toddler brother.
A Solano County jury found 16-year-old Alexander Cervantes guilty on Friday on all counts in the December 2010 attack.
He was charged with two counts of attempted murder; two counts of mayhem; two counts of aggravated mayhem; one count of burglary; two counts of assault with a deadly weapon; one count of rape with a child under 14; one count of sodomy with a child under 14 and two counts of forcible oral copulation with a child under 14.
According to The Reporter of Vacaville Cervantes is scheduled to be sentenced on Nov. 30.
Authorities say Cervantes broke into the girl's home, raped her and stabbed her dozens of times and stabbed her 18-month-old brother before falling asleep.
He allegedly told the girl he was taking revenge because her brother had snitched on someone.
Cervantes was charged as an adult.
His attorney, Erin Kirkpatrick, had told jurors Cervantes was drunk and rambling.

Secret Witness Could Prove Convicted Killer Drew Peterson Murdered Fourth Wife Too

Drew Peterson was found guilty of murdering his third wife, Kathleen Savio, earlier this month, and now new groundbreaking evidence could convict him in the unsolved disappearance of missing wife number four.
According to the new issue of the National Enquirer, police have a secret witness who claims the former Chicago cop asked him to help stalk Stacy Peterson and may even have lured him into helping bury the body.
Police brought (the witness) in for questioning, said a source.He arrogantly went in and told investigators he didnt have any problem talking."
The wannabe cop and police academy dropout told investigators that he met Peterson in martial arts class and soon began trailing Stacy because "Drew was suspicious that Stacy was cheating on him and wanted her followed, said an insider.
The chatty witness reportedly became uncomfortable when police asked about a blue barrel that they say Drew carried from his home in Bolingbrook, Illinois, the day Stacy went missing in October, 2007, and which his step-brother believes her body was hidden inside.
Once they started questioning the witness about the blue barrel he flipped out, the source said.He immediately insisted that he needed a lawyer.
The questioning session ended, but sources say police believe that the witness helped Drew get rid of the barrel.
Apparently spooked, the witness suddenly moved more than a thousand miles away in 2009, soon after Drew was arrested for the murder of his third wife Kathleen, whose naked body was found in the bathtub of her home on March 1, 2004. The witness wife then sold their Chicago home and joined him.
Why leave your hometown? He just bailed. Guilty people act like that," revealed the insider, explaining that States Attorney James Glasgow is drawing up a case for a murder indictment and may offer the witness immunity to testify against the convicted killer.
As for Peterson, when hes sentenced in November, he faces between 20 and 60 years in prison, but will not be eligible for the death penalty as it was abolished in Illinois in 2011.

White father blamed for family murder

A Virginia man is believed to have killed his wife and two sons in a murder-suicide at their home in Virginia, police said today.
The bodies of Albert and Kathleen Peterson and their sons were found Tuesday morning by police performing a welfare check on the family after one of the adults did not show up to work for two days.
Today, Fairfax County police said that the investigation is now pointing toward Albert Peterson, 57, as the killer. All four members of the Peterson family received gun shot wounds to their upper bodies, according to a statement released by the police.
"The preliminary investigation indicates that Albert Peterson killed his wife and their children before taking his own life," the Fairfax County police said in a statement.
Kathleen Peterson, 52, worked for defense contracting firm Blackbird Technologies in Herndon, Va., where the couple lived. Albert Peterson had worked for Northtrop Grumman until he resigned in 2009. It is not clear where he was working at the time of the incident.
The couple had two children: Matthew, 16, a high school sophomore, and Christhoper, 13, who was in eighth grade.
Neighbor Jeremy Wilcox told local news radio station WTOP that the family had attended a community picnic together on Sunday and "showed no signs of any problem."
Another neighbor, Alvaro Lopes, told local news station WNEW that Albert Peterson had tried to commit suicide in the past, and that he had been taking new heart attack medication that seemed to affect his personality.
"He seemed dizzy, just different," Lopes said. "Hearing about what happened today made me think that could have something to do with it."
Police would not comment on any possible connection between the deaths and Peterson's medication.
"They were good people," said Lopes.
Neighbor Jim Steele told ABC News station WJLA that the Peterson were a nice family in the neighborhood.
"This is a horrible tragedy," Steele said. "They seemed like a very nice family. Didn't see anything amiss around the house. It's quite a shock."
Blackbird Technologies released a statement confirming that Kathie worked for the company and expressing their shock. The company works with the federal government on intelligence and defense issues, according to The Washington Post.
"Kathie Peterson worked as an integral and well respected member of Blackbird Technologies' Procurement Team," read a statement by the company. "She will be remembered as a high energy, devoted parent who always had a smile to share. She often told stories about her sons, their sports and community activities. She is already missed. We have lost a member of our Blackbird family. We are still trying to absorb the shock of this tragedy."
Police have not yet released details about how the family died. The bodies of the family members are expected to be investigated by the medical examiner today.

Day 2 testimony wraps up in white man's murder trial

SAGINAW, MI (WNEM)- Day two of testimony wrapped up in Saginaw in the murder trial against suspended Buena Vista Township police officer Ken Bluew.
Opening statements were heard Tuesday at the Saginaw County Courthouse with officers taking the stand to testify on Wednesday. Bluew is charged with first-degree murder in connection to the death of Jenny Webb, a pregnant woman who was found strangled to death near a police shooting range last August.
The prosecution says the baby boy Webb was eight-months pregnant with was Bluew's child.
TV5's Liz Gelardi tweeted Tuesday that during opening statements, prosecutors said Bluew didn't want to pay child support, didn't want his wife to know about the situation and he didn't want a baby.
First up on the stand Wednesday morning was Buena Vista Township police officer Tim Patterson, who was also questioned Tuesday. Patterson was on duty with Bluew the night Webb's body was discovered.
Prosecutor Mike Thomas conducted the questioning and the topic of Webb's cell phone was brought up again. Patterson said Sgt. Waterman, who was with Bluew at the scene of the crime on Aug. 30, 2011, recognized Bluew's phone number in Webb's phone. Patterson said that when Bluew was asked why he called Webb, he replied that the two talked from time to time.
Patterson testified that he felt very uneasy about the call logs in Webb's phone showing communication with Bluew the night of her death. It was revealed in court that Bluew took all of the crime scene photos. Thomas showed several "exhibits" of crime scene photos to the jury, all take by Bluew. Gelardi reported that some of the pictures show Webb tied to the roof of her car. Webb was found with an extension cord around her neck, which was tied to the roof rack of her SUV, appearing as if she hung herself.
Patterson said on the stand that Bluew was the one who found the suicide note at the scene. Patterson says Bluew was not wearing gloves when he handled the note, while he himself did have gloves on.
Gelardi tweeted that evidence contamination could be key in the trial, and that Bluew's attorney can argue that his DNA showed up because he investigated the scene. Gelardi said that Webb's body was moved from the scene before police realized her death might not be a suicide.
Patterson testified that he saw Bluew walk out of the police department with a laundry bag. He said officers usually leave bags at the department for dry cleaning. Patterson said he filed two police reports on Webb's death. One as a suicide and another that was password protected noting the "red flags." Patterson said he didn't want Bluew to see it. Gelardi reported that the defense seized on this fact and attacked Patterson, stating that Bluew had followed proper proceedure and did everything he was asked to do.

LEFLORE COUNTY, Okla.The Thacker brothers, who are both facing murder charges, appeared in an Oklahoma court Tuesday.
Elvis and Jonathen Thacker are accused of murdering a Fort Smith woman, Breanna Ault, in 2010.
A Leflore County judge decided Tuesday that any further court proceedings be put on hold until Elvis Thacker receives a mental evaluation.
The two brothers have already been convicted of rape, kidnapping and attempted murder of an Arkansas police officer.

Criminalist details evidence findings in 'sweethearts' murder case

Excerpt: "The woman as responsible as anybody for setting the case of the UC Davis "sweethearts" killings on its path toward resolution told a Sacramento Superior Court jury Wednesday how she did it.
First, criminalist Kaye Springer told the cops to bring all the evidence they had. Then she went through it, and she found a few things investigators for 12 years had not thoroughly examined.
Springer's search hit the jackpot in 1992 when it turned up four semen stains on a blanket. It took another 10 years, but the DNA in the fluids later matched Richard Joseph Hirschfield, prosecutors say.
He is on trial on double murder and rape charges and faces the death penalty in the killings of the 18-year-old victims, Sabrina Gonsalves and John Riggins.
Her hair is turning gray and she is now a grandmother two times over, but Springer clearly recalled the events of 20 years ago when Yolo County investigators brought in some fibers taken from Gonsalves' hair for her to routinely examine for trace evidence.
"After the fiber analysis, I started asking questions about what case they were using this information on, and I made the suggestion they should just look at everything," said Springer, then working as a criminalist for the state Department of Justice lab in Sacramento.
She testified she looked through pictures of all the evidence in the case and that she noticed a blanket on the floor of a van Riggins and Gonsalves had been driving the night they were killed.
"I thought that might be interesting to look at, and I asked if that might be brought in," Springer said of the blanket.
Davis Police Detective Fred Turner and Yolo County district attorney's investigator John Haynes delivered the red, white and blue "bundle up" blanket to Springer on June 22, 1992.
A couple of weeks later, she took it out of its tattered packaging and tape-lifted it for fiber samples. In the process, "I noticed some stains," she testified.
Springer said they were "yellowish," and located in four discernible spots. She testified she instructed a trainee to run a screen on them, "and they came back positive" for semen.
"I was surprised," Springer said. "I didn't really think I was looking for semen."
She notified the Yolo County District Attorney's Office of her discovery.
"I felt it was a pretty important finding," Springer said in her courtroom testimony.
Prosecutors in Yolo County were about to go forward with a murder trial on four defendants.
The case turned to ashes, however, when DNA extracted from the semen stains excluded all of the defendants. Yolo was forced to dismiss charges.
It wasn't until 2002 that the DNA lifted from the Springer search matched up with samples from Hirschfield submitted to a national data bank, Sacramento prosecutors say. Hirschfield, who is now 63, was then in prison in Washington state for the 1997 rape of a child.
But Springer wasn't finished. By 2002, she had switched over from the state DOJ to a job at the Sacramento County crime lab. About the same time the DNA analysts allegedly were finding Hirschfield's genetic profile lining up with the semen stains, Springer decided to take a look at some slides that had been sitting around for the previous 22 years.
In her scientific investigation in 1992, Springer had ordered up from a private lab some additional testing on the semen to see if it was at all mixed in with saliva.
Sure enough, the tests turned up what Springer described in her testimony as a "moderately strong" presence of an enzyme called amylase, a digestive agent found in saliva.
In her 2002 re-examination of slides taken from the slaying victims, "I was able to actually find sperm on the oral swab taken from Sabrina Gonsalves," Springer testified. She pointed it out to the jury Wednesday on a slide flashed on an overhead projector."

$3M bail set for white lawyer accused of raping 3 women

Police in Seattle and Bellevue believe there may be additional victims, King County Senior Deputy Prosecutor Val Richey told the judge Wednesday in requesting the high bail amount $1 million per each alleged victim.
David Allen, a prominent criminal-defense attorney representing Grant, called the sum "extraordinary" and asked King County District Court Judge Mark Chow to set bail at $150,000 and order electronic home monitoring for Grant.
Allen said Grant, a married father of three, has strong ties to the community. He noted that Grant's wife, Seattle Assistant City Attorney Jennifer Johnson Grant, and one of his law partners, Darrin Bailey, were among those in court Wednesday to show their support for Grant.
"He has every reason to stay. He trusts the legal system. He wants his day in court," Allen said, disputing Richey's contention that Grant is a flight risk.
But Chow, citing the seriousness of the allegations, granted the state's request. Should Grant post bail, Chow ordered that he be put on electronic home monitoring and surrender his passport.
"It's the multiplicity of the allegations that the court is gravely concerned with," Chow said, calling Grant's position as an attorney "diametrically opposed" to the allegations he faces. "We're talking about forced rape with a weapon."
Chow found probable cause to hold Grant at King County Jail on investigation of three counts of first-degree rape and one count each of first-degree burglary and second-degree rape.
One of the women allegedly was raped on two occasions, less than a week apart, Richey said. Two of the three do not speak English.
Formal charges are expected to be filed Thursday, Richey said.
Grant is a law partner at Bailey Grant Onsager, previously known as Stafford Frey Cooper, one of the city's oldest, most prestigious firms. The name change came after three lawyers left to form their own defense firm in April.
According to Grant's profile on the firm's website, he earned a law degree from the University of Kansas in 1995 and a year later, a master of laws degree from the University of Washington.
An employment and business litigator, Grant once worked in the Seattle City Attorney's Office, and he coaches Little League baseball, according to his profile on the social-media site LinkedIn.
Grant was arrested Monday night after the alleged rape of a Mandarin-speaking massage therapist at the Carnation Chinese Massage Clinic on Northwest 85th Street in Seattle's Greenwood neighborhood, according to the probable-cause statement outlining the police case. He allegedly raped the same woman at knife point in a private room on Sept. 19, after paying for a massage, the statement says.
Rae Wu said the alleged victim of Monday's attack emigrated from China six months ago. Wu, who is a friend of Jessie Shao, owner of the Carnation Chinese Massage Clinic, interpreted information provided in Mandarin by Shao and the alleged victim.
The alleged victim was alone in the clinic when a man came in about 9:30 p.m., Wu said.
The woman, who recognized him as the same man who she said raped her on Sept. 19, was on the phone with a friend and, in Mandarin, asked the friend to call Shao, Wu said. Shao called 911, and on her way to the business with two male friends, kept phoning her employee, said Wu, a research scientist at the UW.
"Jessie called her many times and he knew something was up," she said."

Sentencing set today for white man who severely beat toddler

ST. CLAIR COUNTY A Belleville area man is due in court today to learn his fate for beating his girlfriend's 2-year-old daughter so severely in 2010 that the little girl suffered a lacerated liver.
Kraig A. Monroe Jr., 26, faces a sentence of six to 30 years in prison for aggravated battery of a child. Monroe has been free on bond and being monitored by an electronic ankle bracelet since mid-2010. He pleaded guilty in April.
Sentencing is set for 1:30 p.m. today at the St. Clair County Courthouse. His lawyer, Richard Roustio, could not be reached for comment on today's hearing.
Police say Monroe punched Amanda Runyon in the abdomen repeatedly over four days in February 2010 because she wouldn't stop crying at the home he shared with Amanda's mother in St. Clair County near Belleville.
The girl's mother took Amanda to a hospital on March 1, 2010, when she was vomiting and lethargic. Doctors had to remove a quarter of her intestines. Doctors also discovered that Amanda had a broken arm and a broken leg from previous incidents and was missing hair where it had been pulled from her head.
After a 17-day hospital stay in St. Louis, Amanda moved to Kentucky to recuperate with her father, Eddie Runyon.
