A lawyer for the TV news producer accused of blackmailing David Letterman plans to ask a judge to dismiss an extortion case that prompted the late-night comic to acknowledge affairs with staffers.

That was'nt a formal demand to extort money that was a friendly/associates gesture to plea for financial help. Given the seriousness of the offense, its still not sufficient ground for extortion as there wasnt a physical threat and harm involved.
