On a third offense dwi, can a first offense be expunged to reduce the third offense to a second offense?
Cousin arrested on a third offense dwi, and is trying to have the first offense expunged to reduce the third offense to a second offense (non-felony)
An expungement does not reduce the DWI, third offense, to a second offense even if successful. You probably wouldn't...
Can someone who had an 894 and then a second DUI have the DUI expunged?
I was charged with a DUI in 2005 and used an 894. I received a second DUI in 2009 while leaving a dinner party. I am applying for jobs that require a lot of travel and driving and I am worried that a background check will show both DUIs. My first question is will both show up on a background check since I used an 894 for the first? My second question is if my record is otherwise clean, is it possible to have these charges expunged so I do not risk losing a job offer?
Given this factual recitation, it will be very difficult to have either case expunged. But, before taking any action...
Why plead no contest to DUI when blood test was lost?
I was involved Ina head-on MVA after the front end of my car was clipped in a hit-and-run, sending my car into oncoming traffic. The result was a collision with a truck. It was 5 am as I was on my way to work. As the state police were searching my purse for ID they found a prescription bottle of pain medication I had filled the day prior. If they had counted them, it would have been discovered that all were there. I wasn't charged with DUI until over a year later in the course of a civil suit. As it was a hit-and- run that started the chain of command, I'm the only one left to go after in the money train. I called the state crime lab repeatedly and they have no blood test results for me even though one was done upon my ER admission. It was discarded before I was even sent to a room. What I'd like to know is why I'd be advised to plea no contest by my attorney. I was already thoroughly upset at the charge being dismissed due to a technicality, but the idea of pleading no contest seems beyond ludicrous! The assistant DA wants to get my medical records, which as of now the judge has denied.
That is not a question that we can answer. We haven't seen the other evidence, but only have your interpretation of it....
Will I still be eligible for DACA Renewal if I was arrested for DWI but never convicted?
I was driving "buzzed" and speeding so I was arrested, immediately I called my lawyer and he recommended PTI, an one year program so my dwi would never go into my record, I completed the program and i was not convicted, I have all the papers and certifications that shows the program completed. Would they deny my Renewal? Should I get a immigration lawyer or send the application myself? If i send the application on my own should I send the proof that shows I wasn't convicted in the beginning or later on if it gets denied?
You will still need to disclose the arrest. That one year "program" could still be considered a "conviction" for...

What does a continuance without date mean in Louisiana? Does the charge appear as pending on your background check?
I was arrested for a felony 5 years ago. My lawyer and the DA agreed on a continuance without date. I was told if I stay out of trouble for the next three years the charges would be dismissed and everything erased. What will my background check show during the three year probation period?
What will your background check show? It would depend on the source used for the background check. Some are more...
