Is it legal to draw blood befor the implied consent is read in a DWI investigation
I was in a car accident and taken to the hospital with a minor injury at 19:15. The police report says that the cop waited outside my treatment area and filled out his paper work, he asked a nurse to draw my blood, I wasn't informed that it was a law enforcement blood draw. They took the sample at 19:20. The cop said he didn't enter the room until 19:30 and he then read me the implied consent form at 19:32 (he wrote the time at the top of the form) I didn't respond when he was reading it then when he finished I told him that I didn't understand. The doctor asked him to leave so that I could be treated. I told the officer that I would submit a breath sample. He said it had to be a blood sample. The doctor then told him that they already had a blood sample and he again asked him to leave the room which he did. I never consented to or refused the implied consent but they have entered the sample as evidence against me. Is this blood draw legal?
