Aggravated DWI or DWI plea
Hi! I am an international student (F1 visa) and I was arrested and charged with aggravated DWI (BAC 0.21) and hit a utility pole in New York. I was offered either Aggravated DWI with 1 year conditional discharge or DWI with 3 years probation. May I know which one should I take because I am going to mary my girlfriend and I do not know if which charge would prevent me from adjusting my status.
Either way, the acquired state criminal record will be required to be disclosed during any subsequent application...
Does DMV suspension override Criminal suspension if criminal case is plead out before DMV.
I was arrested for an alleged DWI in NY. I refused the brethalyzer and now face a DMV hearing plus court hearing. I know the arresting officer will not show up at the first DMV hearing, so it will be postponed. If I choose to plead guilty to DWI in criminal court where I would hopefully receive a conditional license, will I still eventually have to go to the DMV hearing or is that dismissed? If I receive a conditional license from criminal court can the absolute suspension from the DMV overrule the criminal court conditional license? My main concern here is being able to drive to work as I live 80 miles away with transit options being a 6 hour round trip.
No, the refusal hearing is NOT dismissed. If you take a plea and are sentenced before the refusal hearing date, a...
I am a taxi driver in Westchester. I unfortunately got a DWI last week. It was a refusal. Will I be able to get a conditional?
I spoke to several lawyers but I get different answers. Will I be able to work with a conditional while my case is pending? IT is my first offence of any kind. Please help besides saying hire a good lawyer. No accident. No passengers. No injuries.

I was given a DWI that put 2 felonies on my record when I wasn't even pulled over for drinking what can I do?
I was pulled over for texting and then told to get out of the car because my lic. was suspended. Then I was told to get into the cop car. I was given three tickets one for texting, driving w/o a lic and drinking and driving. I have a misdormeanor DWI. I wasn't given a soberity test or breath test. When I showed up for court there was no mention about the inital ticket for texting. My lawyer never called me back, never was there when I made an apt to see her. I was wondering what can I do. I was given 2 felonies 5 years probation. I have complied with court and probation. But I feel that I wasn't represented. I also have proof I wasn't texting. The cop wrote that I was standing at a red light and I denied the test which I was never offered. Any help or advice will be helpful. Thank you
The texting was the probable cause to pull you over. Once they have a misdemeanor charge to file, they often don't...
