What will happen if I have one violation while having my interlock device that happened 10 months ago?
I have an ignition interlock device on my car and I've had it since February 23, 2015. On May 9th before starting my car my device said I failed, but then passed 8 minutes later. I had used mouth wash a few minutes before leaving the house and I had been using NyQuil throughout the night. I went and got an ETG done two days later, about 48 hours after so I can show I wasn't drinking. If they were going to take away my license because of that, would they have done that back in May when it happened? It's now going on my one year of having the machine, and going on 10 months since that one reading, and I'm getting my information together to have my next license hearing to try to get my full driving privelages back and was just wondering about this. Or could they still take my license away because of that incident back in May, or would they have already done that by now? Or if I go to the hearing could they tell me the if they were going to require me to have my device stay in longer because of that one reading? That's the only time I have ever had a violation while having the device. I called Smart Start and they said the reading was a .039 I do believe. Thank you for you time.

This morning I stupidly used mouth wash before leaving the house to go to an AA meeting because I had gotten sick, and failed my breath test on my interlock device. I instantly started freaking out and had a panic attack, I tried quite a few times to blow, but my breathing was too sporadic for it to work and it eventually said something about, "tampering with device." I then was able to calm myself down enough to blow and passed. What should I expect now? I was not drinking and have not had a drink in over 3 years and I'm really scared they will revoke my suspended license. I am not on probation, I just received my restricted license at the end of February and I had to get the ignition interlock device installed through Smart Start. My device is not locked out or anything.

My situation didnt appear to be this complicated initially, but i was criminally charged w dui in florida and i chose to represent myself. I knew this was a risk i was taking, but i had no $ for a lawyer and i knew i wasnt guilty. Arrested for disorderly person, searched and they found marijuana. Refused a breathalyzer on the seen and in the police station. Charges were disorderly person and possession of marijuana. Went to court and my lawyer read the report and he said it said I tested positive for marijuana. I never gave any consent to be tested and he said they may have tested me when I was asleep.
