Question regarding DUI Bill 186 in West Virginia
I read an article that says West Virginia has passed Bill 186 which allows DUI first time offenders to keep their license and expunge the Dwi record. This is so offenders will be able to keep current jobs or help prevent people from getting jobs due to the conviction on their record. Does this bill only apply to West Virginia? I was convicted of a Dwi last year and was unable to return to my job as an over the road class A driver. I was convicted in New York in my car-it was my first dwi and the only trouble I've ever been in. If I moved to West Virginia could I have my Dwi expunged? I get my cdl back from the DMV in October but there aren't any driving companies who will hire a driver with a Dwi less then 3 yrs old. I would appreciate any advice. Thank you

I was a Class A (CDL) over the road truck driver. I was wearing my sisters contact lenses because I do not have health insurance, I was a month away from getting health insurance so I was wearing a pair of my sisters disposal lenses which were somewhat close to the last prescription glasses I had a 3 yrs earlier when i still had insurance before graduating college. In regard to BAC breathalyzer, is it a law that an officer must take BAC within 20 min. after defendant is arrested?
I was arrested at 11:15 pm on 05/08/2009, BAC sample was taken on 05/09/2009 at 12:37 a.m. Officer signed pre-anlaysis breathlyzer paperwork (the paperwork which checks calabration etc.) saying he observed me for 20 min., read me my miranda rights, and collected sample within 20 min of arrest. He signed on arrest papers (papers that say what im charged with, what he observed etc.) that he collected BAC sample at 12:37am, over an hour after being arrested. Doesn't this prove that he lied on my paperwork when he said he collected sample 20 min. within arresting me when he signed that he actually collected it an hour after i was arrested? Can this help my D.W.I. case, arguing his credibility?

Is it permissible to me magistrated while severely intoxicated
In the scenario where one gets a DWI and gets arrested and put before a judge / magistrate within 30 mins of being in custody without going to the drunk tank to have time to sober up. Clearly sitting before the judge obviously appearing to be severely intoxicated, which would effect the judges overall opinion on the case and ruin first impression. In result, this would completely ruin your chances of fighting the charges and/or having any kind of defense because you have already formulated the opinion that you are guilty before a judge. This would be the same judge you have a future court date with and the judge could use that against you in the court of law. Is this permissible?
Seems just plain stupid to force the disqualification of the judge. He cannot be your judge if you move to have him...
