I went to court for almost 2 years for a DWAI, and a deal was made to plea guilty to a reckless driving in turn for the DWAI. the terms of the deal were "Plea guilty to the reckless driving and give one clean Urine sample, and the DWAI will be dropped with no probation". I provided a clean Urine sample to an out-patient rehab clinic and gave them consent to release my information to my attorney so that he could provide it to the court. there was a month inbetween my court date and my clean sample, the clinic would not send the information to my lawyer on time. but I clearly held up on my end, now im on a year probation and I was wondering how I go about getting Jail time to serve it and how much jail time it would amount to? I am waiting to go to court in Annapolis, MD next month for a second D.U.I. It is my first in Maryland. All my family and friends live in NY. Also, I am attending school in NY this spring. I have no address to live in MD, or anything there really. I am on bail right now, and spent two weeks in the detention center in Anne Arundel County already. Assuming the judge gave me probation for this, I want to know if it is a possibility to have it transferred to NY immediately and fulfill the requirements there. I already started meetings and other positive things, including school in the spring, and the support of my family. I literally have nothing in MD.

my husband is disabled physically and mentally and has a public defender that wants him to plea to a 6 month shock program for 2 seperate dwi's ; one he had beat because he did not do it so he was not indicted on it and it was still pending in town court when he got charged with a 2nd one. The 2nd one he was indicted solely because of being intoxicated and asleep in the drivers seat with the keys in the ignition but the truck was not running or in motion. His appointed attorney will not even return my phone calls at this point and I do not feel it is fair for my husband to have a dwi on his record that he did not do. As a matter of fact he did not do the 2nd dwi neither but was indicted on it and the attorney has told him that he does not have a chance of beating it and WILL go to prison.
