Should I worry about violation for Breathalyzer?
First time DUI offender on court supervision. Court/prosecutor agreed to rescind my summary suspension but still wanted BAID device in my vehicle for 6 months. In the first month I missed a retest (cold morning and letting my car warm up when retest went off) and an incident where the device was beeping so I made sure it was plugged in (not sure if that would be considered tampering). Both times then doing another test and showing "pass". My attorney told me not to worry unless the court sends me a letter. I never had a "warn" or "fail" reading from the device due to alcohol and was always able to start my vehicle. Do you think the court will send a letter about the above violations and hold it against my supervision? Again no alcohol readings and never locked out of vehicle. Thanks
Possibly. If they do you answer it.
What are necessary documents to prepare for a summary suspension hearing? Who should I serve copies to?
I have already filed a petition for a hearing with the circuit clerk. Do I need to send a copy to the Secretary of State? How do I go about a request to produce evidence for this matter?
Currently, if you are arrested for a DUI and there is a personal injury or death, upon a conviction for the DUI arrest,...
So what is the advantage of getting a stipulated bench trial?
I was arrested for DUI in Dupage County, Illinois. I did not blow at the station at all. I did the Field Tests the police said it was poor and I blew on the field over the limit like .11, but they had to clear it out the first time since the officer cleared it out supposedly. They said I can go stipulated bench trial so I am not guilty of the DUI and do the summary of suspension. I have never heard about the stipulated bench trial before.
DuPage County, Illinois may be compared to Winston Churchill's saying:" It is a mystery wrapped in an enigma." in terms...

I was isseued an arrest citation in Wood Dale for obstructing a possible DUI investigation. Am I going to jail?
My friend was pulled over for speeding they asked her to do field tests I told her not to and not to blow. She refused. They gave me a "courtesy ride to the station" and left me om my own outside free to do whatever for 2 Hours. They then let her out and asked me to come inside. Took my fingerprints and photos.... this did not happen until three hours after the traffic stop. I asked them during the traffic stop if i was under arrest numerous times and they said NO everytime. Thanks
Under the scenario you describe, all you did was advise your friend who was stopped for investigation of DUI not to do...
Will arrest for DUI/Child Endangerment resulting in a non-conviction with non-criminal supervision show up on background check
Arrested a little over a year ago for DUI w/ child in car. Received court supervision on both accounts and on non-criminal probation for 2 years. Now going for a new job which asked to do background check. Will this show up and could it effect me getting hired? The company is based out of state so I would work remotely in Illinois. My lawyer stated it is not a conviction. I have to take a drug/alcohol screen once a month while on probation. I've complied and completed all necessary court alcohol treatments and only working on paying fines, finishing probation and completing community service. If it does do I answer them a certain way about it?
Absolutely. Any state DUI arrest regardless of its subsequent legal criminal case disposition is not statutorily...
What happens to his driving records if he plea guilty .
My husband had a few beers at our apartment and when down to stop our car in our apartment. Unfortunately while he took the car he hit the front car and broke the front of the parked car. No one was hurt and no one was near by. He himself called the 911 and police came and arrested him ,took a BAC and it was 0.08. He has zero accident records for the past 15yrs and never does anything like this. It was night and dark ,and he had no food. Since it happened in the private property ,the police did not take his license nor gave him a statutory of summon.
Since the arrest was on private property there should be no statutory summary suspension. That law does not apply to...
