Upcoming charges, is jail time basicallly a definite?
I know someone who has a lengthy list of charges, 1 failure to appear for driving after suspension, 2 driving after after suspension, AND 2 dui (within 2 years of the first one, making a total of 3) They are nervous they are going to jail, is it basically a definite?

Why was I arrested for DWI, non alcohol related, when there was no DRE officer there?
I was up all night the evening before due to an insect infestation. I had to turn over a friends apartment in New Castle for some renting guests on the following day. Prior to arriving there, I was exhausted so I decided to pull over and take a nap before I started work. I turned the car off and slept. Two officers arrived and woke me up, telling me I looked dead (im a very heavy sleeper, AND I have fallen asleep at the wheel-totally sober-twice in my life and ALWAYS pull over when I'm tired) In any case they didn't suspect me of drinking, but asked me to do a walk & turn @ eye test-thats it. I was arrested and they brought me to have blood drawn. I thought they had to have a Drug Recognition Expert conduct a 12 step process?

How do I file a motion to reduce a DUI from a Misdemeanor to a Violation?
I'm filing a motion to reduce my DUI from a misdemeanor to a violation (it has been one year since conviction) and was wondering what the wording on the motion should be. Should I be trying to convince the court why the reduction should take place or should I just be stating that it has been a year since the conviction? If you could provide an example of what it should sound like that'd be great! Thank you for your time

Will I be drug tested, in New Hampshire, while taking a court ordered alcohol program?
I was arrested for transporting a few months ago but it was basically a misunderstanding so I just have to take the ASAP program class. I was wondering if I would be drug tested even though it was an alcohol related charge? I signed a consent form for the class but it only says something about refraining from the use of illicit drugs and alcohol but nothing about being tested for anything. Would they have the right to drug test me when I go to the class? I just want to emphasize that it was only an alcohol related charge so I don't think they would be able to drug test me for drugs?

Should I be prepared for major consequences for transporting alcohol?
I got arrested last night for transporting alcohol. My boyfriend, whom is 21, purchased beer at a gas station 2 minutes away from his house and I was his ride. A police officer was in an undercover car at the gas station and pulled us over immediately after running my plate for an "alcohol compliance check". We were unaware of the law that prohibits me to transport alcohol with him in the car unless we are married. I have no prior arrests or offenses and I was let go easily without having to be bailed out. But I am currently approaching the end of 1 year probation for a speeding ticket of 5mph over the limit. That is my one and only offense. Will I still suffer from a major fine and license loss? Please tell me what you think so I can be somewhat prepared.
