I have 2 DUI charges with serious bodily harm...
I am out on bail with 2 dui. both of the injured parties were my passengers. 1 was seriously injured and had to have surgery and is still, almost 3 weeks later, in the hospital. The other one was kept overnight in the hospital, treated, and released the next day with bruising and stitches. I am wondering if I will have to serve time for this. I blew a point 07 3 hours after my accident. I am hoping to maybe get probation but some things I have read are telling me that because of the serious injuries of one of the passengers, I may be facing jail time. This is my first offense.
All felonies in Florida are scored. The scoresheet also takes your prior record if any into account. Victim injury...
Will a Wisconsin DUI (1st offense, which is only a civil matter) show up on an out of state employer background check?
I received a DUI in Wisconsin in June of 2011 and have since moved to Florida. I'm looking to get a 2nd job but am worried because some of the jobs require a "clean driving record" or the need to pass a background check. I know a DUI usually shows up on these checks, but was wondering if it made a difference that a 1st offense in Wisconsin is not a crime, but a civil offense (it is the only state where this is true, i believe.
It depends on what kind of background check they run and where they pull the information from. There is no single...
Can I be sued even if I don’t have any money or own any property?
I was in a recent accident where it was my fault I had a DUI. I crashed into the back of someone’s car at a stop light, my car was a total loss and the persons car is being fixed by my insurance company on top of that they were not injured at all but they still want to sue me personally. I have no money to pay for an attorney nor do I have money for any compensation I don’t even own property, what would happen to me? Thanks for any help or suggestions.
Your insurance will defend any lawsuit so you don't have to hire an attorney.
Limitations on DUI arrest?
I was in an accident over 15 years ago in Florida when I was young and stupid after drinking. Was injured and brought to the hospital where they blood tested me and said I had alcohol and benzodiazepine in my system. The Benzodiazepine was there because I believe the bar I was in last I was drugged in my drink by a strange couple that was next to me at the bar. I left because I felt woozy and scared. Regardless, I was in the hospital for over a week. There was never an arrest or a visit from police. Moved out of state after that to recover and never heard anything about it. Have checked warrant databases and such but nothing comes up. Can this still come back to get me or was I extremely lucky in a number of ways?
It's possible that you were very lucky. It's also possible that there is a case floating out there that you haven't...
If a drunk driver hit me while borrowing a friends car and I'm uninsured can I still press charges?
My friend let me borrow their car for the night and a drunk driver was driving with his head lights off and crossed over the median and hit my friends car. I was driving and I'm uninsured. The car is totaled. I had my kids in the back seat. We have no serious injuries but we are all still in pain. Can I still press charges and what rights if any would I have to sue?
I believe you’re asking if you and your children still have personal injury cases despite being uninsured. Only the...
First, I would like to thank you in advance for any lawyer that takes the time to give me advice on this matter.
2003 my friend was arrested and charged with possession of cocaine with intent to sell. This was her first offense and she pleaded no contest. She ended up with probation, she can't recall if it was for 1 year or 18 months. She then violated probation and was put on drug offender probation for testing positive for marijuana. They gave her 2 years probation and she was given weekly drug tests. She completed the 2 years with no other incidents. A couple years later, she tried to get her charge expunged and was told she couldn't. Recently, I got into a bit of trouble myself and was charged with a DUI. I hired an attorney and was told the only charges that you can't get expunged are violent offenses and a DUI charge. Maybe I misunderstood, but I'm trying to help my friend out and see if there is any way that the charge can be expunged. If she hires and attorney or is there no hope? I know this doesn't make a different but she is a single mom and is missing so many opportunities to better her life because of this. I know it was her fault but i figured asking a professional wouldn't hurt. ANY help is greatly appreciated.
If she was adjudicated guilty of the cocaine possession charge, she will NOT be able to get her case expunged ever. In...
How can you become a trustee when the CO ignores you?
My son had a violation of probation, is 19 and does not have any prior criminal history. It was for possession of marijuana under 20 grams and parafanalia (which was the paper). They put him in for over 3 months and suspended his license for a year when he gets out. The CO's are ignoring him and I had to call to get him medical attention because he filled out 5 forms to see the nurse. Now the CO's are being rude to him because he said something to me, his mom. He has filed the paper to become a trustee and now they are ignoring him. I don't know what I can do to help. He didn't deserve that much time and didn't deserve his license being suspended. He is just 19 and has never been in trouble. Now he's trying to become a trustee to make the time go by and get time off his sentence and they are ignoring him. There has got to be something I can do. I feel my hands are tied literally and they are just going to get away with this.
Unfortunately there is nothing you can do to help you son become a trustee. The decision as to who becomes a trustee...
