Hi, I am hoping you can help me with some answers. Around 10 years ago I was in an accident that I did not get ticket for.
My lawyer told me there was a 2 year statute of limitations. My insurance lapsed because I lost my job of 25 years and it was food for my kids or insurance. About 4 years ago I was in a coma for about 8-9 days and when I got out of the hospital I had a letter stating I owed $100,000+ and my license was suspended. Later I put a car in my name that had insurance and that broke down and was towed to a persons house I didn't know. While I was in the coma, the insurance wasn't paid. I called DMV to see if I could sign a paper saying the car was UN-drivable, but they needed the tag I could not get. My Dad is having major surgery and is the only driver. I am on disability as I have MS, etc., and cannot afford to pay State Farm! That was the only paper I ever received regarding any of this!

Will I need an attorney for a first time DUI?
This is my first offence in anything. My records are otherwise clean. My report reads that I had fallen asleep at a stop light (it was around 4am) with my foot on the break when the arresting officer woke me and proceeded to perform the field sobriety tests. I was compliant throughout the process, but I'm also seeing my BAC was at .173/.172... And I'm not sure of the likeliness of being able to successfully request at least an hardship license before my 10 days are up. Or what options I may be eligible for- because I did see in the DMV handbook that first time offenders do have an option for reinstating a suspended license due to a DUI. I will probably need an attorney anyway if I want to have the incident expunged. So if I plan to do that is it best to just get an attorney asap?

DUI / Headlight out is not illegal
I was driving home last week from the bar and I got pulled over for having a headlight out which is not ILLEGAL so when he smelled alcohol on my breath I got the sobriety test where I walk and do tests and I failed every one miserably I fell a couple times. My BAC was .34% so not sure if I will get impaired driving for this or not but while I was talking to the officer he said he would suggest i fight the DUI because he shouldnt have pulled me over for the head light out and he said it was out but its not illegal so the sobriety test is inconclusive so i shouldnt get charged with a DUI. do i go to court anyway or should i just skip it all together since it'll be thrown out anyway??
I have never heard of a police officer telling someone they stopped them illegally. I would image in the police report...
