From your facts it appears that you are eligible for a step-down reduction in the penalties, to those of a second DWI....
Can the prosecutor drop a .19 breath test result down to a .14 in the state of nj?
Pulled over for reckless driving and speeding 75 in a 50 and was charged with dui. I blew a .19. I'll be speaking to the prosecutor myself at trial but would like to know if I can request that he drop the breath test reading down to .14 so that I don't need to get the interlock on my car before my license is restored. NJ is a tough state and I'm told you can't do much here about these types of charges. This is my first and only offense of any kind ever.
The prosecutor cannot drop the reading as you suggest. However it is possible to have the reading suppressed under...
I completed the ARD program in PA for DUI and paid off all fines/fees as of March 2011. What is the next step ?
Accepted in ARD in PA, completed all classes and paid off all fines/fees by the required deadline of March 2011. I now work (part time) for a school district in NJ and recently had to have my fingerprints done and background check. What is going to show up? How do I go about getting this record expunged? Is this why I haven't been able to find full-time employment in NJ??? Please advise and thank you for your help.
As far as the procedures following an ARD in PA, you must speak with a PA lawyer or post your question to PA lawyers....
1st Offense DUI NJ. 2nd Offense DUI PA
I was convicted of DUI in NJ in 2004. I paid all surcharges and lost my license for 3 months. I was arrested last night in Philadelphia for DUI. Will NJ be notified? Will I lose my license? More importantly is this considered a 2nd offense? Will I do jail time? So scared!
Depending on how your PA DUI is resolved, the NJMVC will most likely be notified of the outcome of the matter. In the...
Need advice on reckless driving and other tickets, 2 previous DUIs (NJ)
I had to drive a friend and her car home from a bar around midnight. I was not familiar with the area and was receiving directions from an intoxicated passenger. We were followed by a police car as soon as we left the bar and there was some hesitancy in my lane changes regarding the directions. We were pulled over, I was never told why. They ran our licenses, I have 2 previous DUIs. I was made to do a field sobriety test which I passed. I was then issused the following tickets: 39:4-67 Obstructing Passage of Other Vehicles, 39:4-88B Traffic on Marked Lanes, Unsafe Lane Change, 39:4-56 Delaying Traffic, 39:4-97.1 Operating at a Slow Speed Blocking Traffic, 39.4-96 Reckless Driving. There was no sign of any traffic disruption. The Reckless requires a court date. How should I handle these?
Get a good lawyer and have the tickets consolidated.
Would I be eligible for unemployment if a DUI that's been pending for over a year just now goes through since new employment?
Ive had a pending DUI for over a year. Lost my old job but received employment since but I drive a company vehicle. I'm not sure on company policies with respect to this situation so I can't give any input there. But my general question is would I be eligible for unemployment since the DUI had no relevance to employment up until now? Also it hasn't officially gone through yet, if the DUI is generally a problem with unemployment in NJ, would it make more sense to attempt to get fired or laid off by some means? And if that's the case, how so?
You need to ask an attorney more familiar with the unemployment regs. If you are terminated for cause it may be a...
Failing to install IID
I was convicted of a 2nd DUI 09/25/2014 in NYC and as a condition was told to install a IID. While planning to sell the car. I had gotten my car back from the impound in January 2015. Since then my license was revoked for 6 months therefore i was not able to drive the car. When the revocation was lifted, license was still in suspended status therefore sill unable to drive and unable to go to install the IID in the car. It has been a year and I had gotten a call from my attorney indicating that the ADA has called and informed that I have violated the terms of the order. What can I do? what can be the outcome?
The fact that your license was revoked and you were not allowed to drive did not mean you didn't need to get the IID...
