Completed ARD in Allegheny County in 2009/10 - will it show up on FBI Background Check now?
I was arrested for a DUI in 2009 in Allegheny County. I completed ARD in early 2010. Now undergoing FBI background check (including fingerprints) for federal employment. Will this show up? How can I get a Certificate of Dismissal from the Court if the case has been "expunged"?
Unfortunately, there will always be an FBI record of your offenses. If you are applying for a federal job, your DUI...
Will I be required to submit to a blood test at my D&A assessment for a DUI?
I was arrested for my first (and only) DUI and refused a BAC test at the time of arrest. I recently completed my CRN evaluation per the conditions of ARD. I was told that prior to scheduling my AHSS classes, I would be required to submit to a full D&A assessment because of my BAC test refusal. I'm quite confused: considering my BAC refusal, will the assessor attempt to take my blood, breath, urine at the time of the assessment (or for any other reason), or can I just expect a battery of questions (similar to the CRN eval, but more in depth)? I've nothing to hide, but I would like to know in short what I might expect at my D&A assessment.
As a general rule, I tell people assume you will be tested everytime you go to court for anything. The reason for this...
Will I get sent to ohio for a probation violation after getting jail in pa for 2nd dui?
Currently on basic probation in ohio since I live in pa. (No monthly visits nor piss test, just paying fines) I recently got a dui in pa and gonna have to serve 5 days in pa.. Question 1, Will ohio see I'm in jail in pa and put a detainer on me to send me to ohio to serve my remainder probation time? Question 2, Will Pa put a detainer on me and contact Ohio for my probation violation then send me to Ohio?
1) Yes, if they look. 2) No, not if there is no PA probation officer supervising you on behalf of Ohio.
If a Dui says Nolle processed does it still count against me if I receive another Dui?
I had two Dui that were put together. I was sentenced in 2008 for my second Dui. The other says Nolle processed. I Got another Dui recently, will this be my 3rd or my 2nd again?
Good news for you. If a criminal case is nolle prossed then it is as if you were found not guilty. For sentencing...
I got arrested, first time DUI in PA. I blew pretty high,.25. Am I looking at jail time?
The police officer asked me while I was in the holding cell if I wanted to use the address of my license for the address they would send my court papers to, I replied yes. Turns out he wrote "308" instead of "302" and I never got the papers. A warrant was issued for my arrest after I didn't show up for court and I went to jail for 14 hours because of this mistake. I turned myself in after hearing that cops showed up to my house(I was out of town). I now have paperwork confirming this error. The judge eventually let me leave and issued me a new court date. Does this clerical error help me in anyway? The summons was sent to an address that does not exist which caused me a serious headache.
More facts are needed to fully assess your situation but it is possible you avoid jail time. You should talk...

I was in the process of moving to the city i was getting sentenced in to be in a program that would of been.beneficial. i needed my lawyer to put in for a continuence however he failed to do so. I do not have the funds for a new lawyer, I have now two warrants for my arrest...i am so scared. Ive never been in this position nor had any warrants. I am very scared, confused & idk what to do
So, let's get this straight. You were on your way to sentencing when you were arrested for a third offense DUI? - So...
Is it possible to get a license (even a restricted one), for work purposes before paying off the entire fine?
I have been through the entire restriction time for my license following my conviction for a DUI. The problem I'm facing is that I live in an area where it is impossible for me to get a job to pay off my fine without being able to drive to and from work. From what I understand even the occupational restricted license required full payment of the fine. I have no money to pay the fine and am unable to get any money to pay the fine unless I'm able to drive, which I cannot while my license is suspended because the fine hasn't yet been paid. I'm in a Catch-22 situation here, what can I do?
The real challenge with your question is that you are absolutely right. Payment of the fine is critical in restoration...
