My son is on supervision for a DUI. He has no income. He is unable to pay his $1900.00 court cost. Will he go to jail?
He is on supervision for his first DUI. He fulfilled all of the requirements set forth by the courts. His final hearing is in March at which time he is to pay his court costs of $1900.00. He has no income and is 28 years old. If he can't pay his court costs, his case manager told him he would go to jail for 30 days. Is this true?
Hopefully your son has a lawyer. If not, he should at least consult with one. Has your son's case been continued...
Received DUI in 2005 & retail theft in 2001 & 2002 -- Have been permanent resident since 1988
My court date is finally tomorrow I cannot express my fear. I was put in deportation proceedings after I applied for Citizenship in 2008 for crimes of moral turpitude due to my 2001 & 2002 retail theft convictions. I am now 36 yrs old happily married with 2 small children, boy 5 yrs and girl 15 months and I am 3 months pregnant. I have been at my job almost 5 years and I am deeply sorry for my mistakes and bad judgement. All fines, probations, supervison and requirements were met. And I do not have any aggravated crimes. What are the chances everything will be ok tomorrow? I entered the US in 1985 with H-4 Visa with my parents and siblings (I was 9 yrs old at the time).
You can hope. You've run afoul of the law three times in seven years. That may not impress the decision maker.
BAIID Device possible violation, questions..
I had an issue with my BAIID device. It is a FR9000 ignition interlock. I was driving from work andalready completed one rolling test. I then turned on the air conditioning and realized that the screen on the sample head shut off. I found this weird as it has never happened before. I turned the AC off and after a few minutes, the BAIID device came back on. I did this a few more times to confirm that the AC was causing this and it was. Later in the drive, it asked for a retest. I began to blow but couldn't get the timing right with the beeps. I thought the device was malfunctioning. There seemed to be more beeps than before. It continued beeping and being afraid that the car would turn off in the middle of the road, I pulled off the road, turned off the car and restarted. What should I do?
You can document the problem by contacting the installer but most of them are reluctant to help or admit their fault....
Hi, I was just issued an RDP along with the requirement for a BAID and I had a question.
I was wondering whether or not the SOS can see the times/dates of my breath samples into the BAIID to determine whether or not I'm driving within my allotted days/times and possibly issue violations based on that? Anyone have experience with this issue? I'm not planning on violating my driving hours but sometimes things happen--being stuck at work later, having to move cars around so family can get in/out of the garage, etc.
Yes. Every single blow is recorded. The SOS will not review each one as a matter of routine. The danger would be if...
Just arrested for DUI in Chicago. Blew 0.134. First offense. Can I get supervision with guilty plea/finding?
Officer pulled me over for following too closely. Proceeded with DUI investigation. Voluntarily submitted to breathalyzer and blew 0.134. Was unaware that I could refuse the test or of the consequences for failing. The officer told me that it was nothing to worry about since it was my first offense. I was never offered a telephone call until I had already been arrested and processed. Upon being released and viewing the documentation I was given a total of 5 violations, I only knew of 2 DUI & following too closely.
You are eligible for supervision on a first offense. You should consider speaking with an attorney for your case.
I need a DUI lawyer that can handle an appeal.
I was in a car accident 4/17/15. I was taken to the ER and examined. I was given Tylenol extra strength and Ultram. The hospital didn't write down I was given medication. I had to leave blood and urine samples. 8 months later, I receive a letter in the mail saying my license will be suspended for 6 months because of what was found in the blood and urine samples. I contested the suspension and in court found the only thing found in testing was Acetaminophen in my urine. I told them that acetaminophen was Tylenol and not a controlled substance. They didn't believe acetaminophen was Tylenol and upheld the suspension. Every person I have spoken to says this is wrong. 3 things. First the samples were taken after I was released from the ER and not before. Second, according to one attorney, a illicit drug test would not have detected acetaminophen but a medical test would have so I was given the wrong test. Third, acetaminophen is over the counter medication and is not controlled. The suspension will be up next week but I don't want a false DUI on my record and I want to find out who said acetaminophen was a controlled substance and take legal action against them.
You do not need an appellate attorney, You need a good DUI defense counsel who also handles hearings. Apparently you...
What can I do about court fines for a DUI?
Hello, in 2014 I received a DUI in Cook County, Illinois. I was sentenced to 2 years probation, 90 hours of Alcohol abuse treatment, 200 hours of community service, Impact panel session, revoked license, probation fees, required to pay re-instatement fees for my drivers license, and lastly $2,914.00 in Court fines, I have completed everything, except, paying my reinstatement fees for my Drivers license which I believe is $550.00, and the $2,914.00 in court fines. Probation fees, treatment, and community service have been taken care of, but with me being disabled and on a fixed income, of 871.00 a month has made it nearly impossible for me to save the money for the court fines. The most difficult part is the fact that I live 4 hours away in western Illinois away from Chicago. My probation will becoming to an end in December of this year 2016. I was told that I am to pay my fines in full at my last hearing in Cook County, less the reinstatement fees which will be sent to Springfield. I do not know what to do about the fines. I would like to know if there is some leniency when it comes to fines? Thank you for your time.
You should discuss all options with your lawyer rather than relying on this online forum. Hopefully you had a lawyer...
